Warroad (trfnews.i234.me) — A Warroad man appeared in court Monday, May 4, on two criminal sexual conduct charges involving a minor under age 16.
Kyle James Rourk, 33, is charged with first-degree criminal sexual conduct. He is also charged with second-degree criminal sexual conduct. The charges are tied to alleged acts involving a minor.
According to a probable cause statement filed in the case, the minor reported Rourk to law enforcement in March. The statement says the alleged acts happened years earlier. It also says the most recent alleged act happened about two years before the report.
Charges Filed In Minnesota Court
First-degree criminal sexual conduct is among Minnesota’s most serious sex crime charges. State law can be reviewed through the Minnesota Revisor of Statutes.
Second-degree criminal sexual conduct involves alleged sexual contact under certain facts. That law is also listed by the Minnesota Revisor of Statutes.

Bond Conditions Set
Law enforcement spoke with Rourk on March 9. The probable cause statement says he denied the allegations. He was arrested the next day.
Rourk has since bonded out of jail after posting $7,500 cash. His bond conditions include no contact with the minor. He also cannot use alcohol or controlled substances.
Other conditions bar him from leaving Minnesota without written court approval. He cannot possess weapons. He must also submit to testing and searches.

Next Hearing Scheduled
Rourk’s next hearing is an omnibus hearing. It is scheduled for 1:03 p.m. on Aug. 10.
An omnibus hearing is used to address pre-trial issues. Those issues may include disputes over evidence. These hearings are sometimes waived.
If the case moves forward, a plea may be entered after that step. The charges remain allegations unless proven in court.
