Fosston Shooting Suspect Released as Probe Continues
FOSSTON (trfnews.i234.me) — A Fosston man arrested after a fatal apartment shooting has been released from custody.
Cory Burnette Jr., 22, was arrested Monday after TeeJay Alvarez, 31, was shot inside a Mark Avenue apartment.
The shooting happened in the 300 block of Mark Avenue in Fosston.
Alvarez was taken for medical care after the shooting. He died Tuesday morning at Essentia Health in Fargo.
Why Burnette Was Released
The Polk County Attorney’s Office announced Burnette’s release on Wednesday.
Prosecutors said they cannot decide on charges until the full investigation is complete. That review includes the final autopsy report.
Burnette had been held at the Northwest Regional Correctional Center in Crookston.
He was held on probable cause for second-degree assault and discharging a firearm.
A probable-cause hold does not mean formal charges have been filed.

The attorney’s office said state law limits how long someone may be held without charges.
Officials said Burnette was released because the investigation remains unfinished.
The release does not end the investigation. Prosecutors may review the case after receiving all reports and evidence.
Investigation Remains Active
The attorney’s office said it will not provide more public comment for now.
The office plans to speak again after the investigation ends and a charging decision is made.
The Fosston Police Department is leading the investigation.
Several agencies are assisting with the case.
They include the Polk County Sheriff’s Office and the Minnesota Bureau of Criminal Apprehension.
The Minnesota Department of Natural Resources is also assisting.
The Minnesota State Patrol is providing additional support.
Authorities have not announced a final cause or manner of death.
No criminal charge had been announced when officials released their statement on Wednesday.
The case remains under review by investigators and prosecutors.
An arrest is not a conviction. A person is presumed innocent unless proven guilty in court.
Further updates are expected after the final autopsy and investigation are completed.
