Fosston Shooting Suspect Released as Probe Continues

FOSSTON (trfnews.i234.me) — A Fosston man arrested after a fatal apartment shooting has been released from custody.

Cory Burnette Jr., 22, was arrested Monday after TeeJay Alvarez, 31, was shot inside a Mark Avenue apartment.

The shooting happened in the 300 block of Mark Avenue in Fosston.

Alvarez was taken for medical care after the shooting. He died Tuesday morning at Essentia Health in Fargo.

Why Burnette Was Released

The Polk County Attorney’s Office announced Burnette’s release on Wednesday.

Prosecutors said they cannot decide on charges until the full investigation is complete. That review includes the final autopsy report.

Burnette had been held at the Northwest Regional Correctional Center in Crookston.

He was held on probable cause for second-degree assault and discharging a firearm.

A probable-cause hold does not mean formal charges have been filed.

The attorney’s office said state law limits how long someone may be held without charges.

Officials said Burnette was released because the investigation remains unfinished.

The release does not end the investigation. Prosecutors may review the case after receiving all reports and evidence.

Investigation Remains Active

The attorney’s office said it will not provide more public comment for now.

The office plans to speak again after the investigation ends and a charging decision is made.

The Fosston Police Department is leading the investigation.

Several agencies are assisting with the case.

They include the Polk County Sheriff’s Office and the Minnesota Bureau of Criminal Apprehension.

The Minnesota Department of Natural Resources is also assisting.

The Minnesota State Patrol is providing additional support.

Authorities have not announced a final cause or manner of death.

No criminal charge had been announced when officials released their statement on Wednesday.

The case remains under review by investigators and prosecutors.

An arrest is not a conviction. A person is presumed innocent unless proven guilty in court.

Further updates are expected after the final autopsy and investigation are completed.

    I don’t know the family but I definitely feel their pain losing a loved one that way 💔

  3. Most places would charge him with what you got now then add or up the charges later, not say you can’t decide so let him go. Very weird situation.

  4. Wtf,This makes no sense to me?
    A person was shot, and later died, and the person who did it gets to walk free? Regardless of the situation of why it happened, he killed someone, why isn’t this enough to keep him locked up.. my little brother is doing life, for shooting and killing someone in self defense..
    Someone from teejays family should do a go fund me to hire a good lawyer to defend teejay, because the county and state aren’t.. and then file a lawsuit against the county itself.. this article says innocent until proven guilty, the guy is guilty of committing a crime, and someone died, multiple different kinds could be used to hold him.. wtf!!

  5. From what i heard, and could easily be wrong, they released him because they didnt have exact charges set yet until the investigation concludes. I personally think he should be locked up pending the results of the investigation but my understanding is that if they charge him incorrectly he can get off on everything so theyre trying to make sure that doesnt happen. Again, could be very wrong, just what ive gathered talking with ppl about why hes free currently.

  7. Informants always get off easy. Pays to be a snitch. The rest of us get everything taken away from us and suffer a cross like Jesus.

    If we would crack down on these snitches like they use to the problems would disappear. The rest of us have to endure chastisement like a GOOD SOLDIER.

    Maybe it’s time fear ruled the land once again.
