Warroad Man Faces 3 DWI Charges After .142 Test
WARROAD, MN (trfnews.i234.me) – A 28-year-old Strathcona man faces three gross misdemeanor charges following an October 3 traffic stop in Warroad.
Dayton Ronald Bishop is accused of driving while impaired, refusing a chemical breath test, and violating an ignition interlock restriction.
According to a Roseau County criminal complaint, a preliminary roadside breath test showed an alcohol concentration of .142.
Investigators also reported discovering an outstanding North Dakota arrest warrant during the traffic investigation.
Trooper Follows Vehicle Through Warroad
The incident began around 10:01 p.m. on October 3, 2026.
A Minnesota State Patrol trooper observed a Chrysler 200 traveling westbound on Highway 11.
According to court documents, the vehicle turned onto Lake Street Northwest before entering a Circle K gas station.
The trooper checked the vehicle’s registration information while monitoring its movements.
The records check reportedly identified an active arrest warrant from Cass County, North Dakota.
The warrant involved a simple assault charge and allowed extradition from surrounding states.
After leaving the gas station, the vehicle returned to Highway 11.
The trooper initiated a traffic stop near Gladys Street.
Driver Identified as Dayton Bishop
During the stop, the driver provided a Minnesota driver’s license identifying him as Dayton Ronald Bishop.
According to the complaint, Bishop was the vehicle’s only occupant.
The trooper informed Bishop about the outstanding North Dakota warrant.
While speaking with him, the trooper reported smelling alcohol coming from the vehicle.
The officer also noticed Bishop’s driver’s license carried an ignition interlock restriction.
When questioned, Bishop reportedly acknowledged that his Chrysler did not have an ignition interlock device installed.
Bishop Admits Drinking Alcohol
Investigators asked Bishop how much alcohol he had consumed that evening.
According to the complaint, Bishop said he had consumed “two, three shooters.”
He identified the alcoholic beverages as 99-brand shooters.
Bishop reportedly said his last drink was around 8 p.m.
The trooper asked Bishop to complete several field sobriety tests.
During an eye movement test, the trooper observed four possible indicators of impairment.
However, officers reported no impairment clues during the walk-and-turn or one-leg stand tests.
Roadside Breath Test Shows .142
Bishop agreed to provide a preliminary breath sample during the roadside investigation.
According to the complaint, the test showed an alcohol concentration of .142.
That result exceeded Minnesota’s standard legal limit of .08.
The preliminary reading was approximately 1.8 times the legal limit.
Dispatch also confirmed the outstanding North Dakota warrant during the stop.
Officers arrested Bishop on the warrant and suspicion of impaired driving.
He was then transported to the Roseau County Jail.
Driver Allegedly Refuses Additional Breath Test
At the jail, the trooper read Bishop the Minnesota breath test advisory.
According to court documents, Bishop indicated he understood the advisory.
He also declined the opportunity to consult an attorney before deciding whether to provide another breath sample.
When asked to take the evidentiary breath test, Bishop reportedly refused.
He stated, “I’m not blowing again.”
The trooper explained the difference between the preliminary roadside test and the evidentiary testing process.
Bishop reportedly maintained his refusal, saying he had already provided a roadside sample.
Authorities documented the refusal and transferred Bishop to jail staff.
