Frazee Woman Faces DWI Charges After Crash, 0.21 Test
FRAZEE, Minn. (trfnews.i234.me) — A woman faces two gross-misdemeanor DWI charges following an October 22, 2026, crash in Frazee.
Cassie Lyn Kostka, 43, was charged after investigators reported an alcohol concentration of 0.21 during breath testing.
The charges were filed in Becker County District Court following an investigation into the nighttime accident.
Deputies Respond to Damaged Jeep in Intersection
According to the criminal complaint, deputies received an accident report at approximately 8:37 p.m.
The crash occurred near the intersection of County Highway 10 and River Drive South in Frazee.
When a deputy arrived, a Jeep Renegade was sitting in the intersection with significant front-end damage.
The vehicle was also leaking fluid, according to the complaint.
Kostka was standing next to the driver’s door when authorities arrived.
Investigators reported that she appeared unsteady on her feet.
The deputy also noticed a strong odor of alcohol, slurred speech, and bloodshot, watery eyes.
The complaint does not explain how the crash happened or identify another vehicle involved.
No injuries were described in the supplied complaint excerpt.
Breath Tests Reportedly Show 0.21 Alcohol Concentration
According to court documents, Kostka agreed to participate in field sobriety testing at the accident scene.
Her performance led the deputy to believe she was impaired.
A preliminary breath test reportedly showed an alcohol concentration of 0.21.
Authorities arrested Kostka for suspected impaired driving and transported her to the Becker County jail.
At the jail, she was read Minnesota’s Breath Test Advisory.
Kostka consulted with an attorney before agreeing to another breath test.
That test also reportedly produced an alcohol concentration of 0.21.
The reported reading was more than twice Minnesota’s general legal driving limit of 0.08.

Two Third-Degree DWI Charges Filed
Prosecutors filed two counts of third-degree driving while impaired against Kostka.
The first count alleges she operated a motor vehicle while under the influence of alcohol.
The second alleges she operated a vehicle with an alcohol concentration of 0.08 or higher.
Both charges stem from the same October 22 incident.
The complaint alleges one aggravating factor was present.
Under Minnesota Statute 169A.03, an alcohol concentration of 0.16 or higher qualifies as an aggravating factor.
Minnesota Statute 169A.26 classifies third-degree DWI as a gross misdemeanor.
Under current law, a gross misdemeanor carries up to 364 days in jail and a $3,000 fine.
Those are possible maximum penalties, not sentences imposed in Kostka’s case.
Case Filed in Becker County District Court
The case is filed under court number 03-CR-26-2077 in Minnesota’s Seventh Judicial District.
The complaint identifies October 22, 2026, as the date of both alleged offenses.
No conviction, sentencing order, or final case outcome was included in the supplied documents.
Readers can search for updates through Minnesota Court Records Online.
Additional court information is available through the Becker County District Court.
Kostka is presumed innocent unless and until proven guilty in court.
