East Grand Forks (trfnews.i234.me) — An East Grand Forks man is facing three charges in Polk County District Court.

Benjamin Ryan Leonard Bayliss, 32, is charged with third-degree DWI test refusal.

He is also charged with fourth-degree DWI and obstructing legal process.

The case was filed in Minnesota’s Ninth Judicial District.

The court file number is 60-CR-26-501.

Police First Called To Home

According to the complaint, police were called on April 16, 2026.

The call involved a reported dispute between a mother and adult son.

Officers spoke with Bayliss at the home.

The complaint says officers believed he showed signs of intoxication.

Officers offered Bayliss a ride to a hotel several times.

They also told him not to drive that morning.

The complaint says officers then left the home.

An officer stayed nearby due to concern that Bayliss may drive.

Traffic Stop On Bygland Road

About 30 minutes later, police saw a man enter a black Subaru Outback.

The complaint says the vehicle was registered to Bayliss.

Police later identified Bayliss as the driver.

Authorities reported that the vehicle did not stop behind a marked stop line.

A traffic stop was made in the 300 block of Bygland Road SE.

Complaint Says Breath Test Was Refused

During the stop, officers reported a strong odor of alcohol.

The complaint says Bayliss had watery and bloodshot eyes.

Police asked Bayliss to complete field sobriety testing.

The complaint says he had trouble following directions.

Authorities also reported signs of impairment during testing.

Bayliss was placed under arrest.

The complaint says he became combative and did not follow commands.

Police later read the breath test advisory to Bayliss.

Bayliss asked to contact an attorney, according to court records.

The complaint says he later refused a breath test.

Charges Filed In Polk County

Bayliss is charged under Minnesota Statute 169A.20.

The third-degree DWI refusal charge references Minnesota Statute 169A.26.

The obstruction charge falls under Minnesota Statute 609.50.

The most serious count carries up to 364 days in jail.

It also carries a possible $3,000 fine.
