East Grand Forks, Polk County (trfnews.i234.me) — An East Grand Forks man is facing two felony charges after a violent fight early March 13, according to a criminal complaint.

Daniel Caleb Demery is charged in Polk County with domestic assault by strangulation and threats of violence. Court records say the alleged assault happened at a home on Mars Drive in East Grand Forks.

What The Complaint Says

According to the complaint, police were called at about 3:01 a.m. for a report of an ongoing fight. When officers arrived, they found Z.D. bleeding from the nose and struggling to catch his breath.

The complaint says Demery had been staying at the home for two nights. Z.D. told police that Demery was his younger brother and did not live there full-time.

Court records say the two had already fought earlier that night in Grand Forks, North Dakota. The complaint says they were later dropped off at the East Grand Forks home.

Z.D. told police he locked Demery out after they got back. The complaint says Demery then kicked the door open and rushed inside.

According to the complaint, Demery threw Z.D. around and choked him twice. Z.D. told police he could barely breathe and had to kick Demery away. The complaint also says Demery threatened to kill him during the fight.

Authorities arrested Demery at the scene. The complaint says he was later taken to the Northwest Regional Corrections Center.

Charges And Case Status

The first charge, domestic assault by strangulation, is a felony. The complaint lists a maximum penalty of three years in prison, a $5,000 fine, or both.

The second charge, threats of violence, is also a felony. The complaint lists a maximum penalty of five years in prison, a $10,000 fine, or both.

The case is filed in Minnesota’s Ninth Judicial District under court file 60-CR-26-341. As with all criminal cases, the charges are allegations until proven in court.
