Court records say officers were called at about 11:07 p.m. on Dec. 11, 2025, to EOSIS Northern Plains Treatment Center in East Grand Forks.
The complaint says staff reported two clients were damaging property inside the building.
Records also say a fire alarm was pulled.
When police arrived, the complaint describes damage that included broken Christmas decorations and other items.
The filing says McCuiston was seen holding a phone receiver and cord.
Records say an officer told him to put it down due to safety concerns.
The complaint says he did not comply at first.
Police reported he later threw the phone to the side.
Threats Alleged During Arrest and Transport
According to the complaint, officers tried to arrest McCuiston for property damage.
Records say he did not follow commands and pulled away during handcuffing.
The complaint says McCuiston then made threats toward an officer.
Officers reported he said he would kill the officer and cut his throat.
The filing says he confirmed the threat when asked.
Court records also describe more threats during transport to the Northwest Regional Corrections Center in Crookston.
The complaint says McCuiston repeated threats to kill the officer and slit his throat.
