AKELEY, Minn. (trfnews.i234.me) — Cole Douglas Lego, 24, faces two charges following an October 17 traffic stop in Hubbard County.
The criminal complaint accuses Lego of second-degree DWI test refusal and possessing an open alcoholic beverage container in a vehicle.
The case is filed in Minnesota’s Ninth Judicial District under court file number 29-CR-26-968.
Traffic Stop Reported on Highway 34
According to the complaint, a deputy was traveling east on Highway 34 near Highway 64 around 11:07 p.m.
The deputy reported seeing a dark Buick Enclave turn onto the highway near the Red River Bar and Grill.
The complaint says the vehicle then crossed toward the fog line and center line near Horseshoe Road.
The deputy stopped the vehicle and identified Lego as its driver.
The complaint states that the deputy noticed watery, bloodshot eyes and smelled alcohol coming from the vehicle.
Lego reportedly told the deputy he was returning from a friend’s Halloween party.
Complaint Describes Roadside Sobriety Tests
The deputy conducted field sobriety tests and reported signs of possible impairment.
According to the complaint, Lego lost his balance, used his arms for support, and stepped off the line.
During another test, he allegedly lowered his raised foot four times.
The deputy also reported that Lego declined a roadside preliminary breath test.
Authorities then arrested Lego and searched the Buick.
The complaint says the search uncovered a mixed cocktail carton labeled 11% alcohol.
It also reports that a smoking pipe containing marijuana was found.
The complaint lists no separate drug-possession charge.

Breath Test Refusal Alleged at Hubbard County Jail
Lego was taken to the Hubbard County Jail, according to the court document.
At 12:20 a.m. on October 18, a deputy read him Minnesota’s breath-test advisory.
The complaint says Lego wanted to contact an attorney but did not reach one.
At 12:29 a.m., he reportedly said he was finished trying.
When asked for a breath sample, Lego allegedly responded that he wanted to go to bed.
The deputy informed him that test refusal was a separate crime.
The complaint states that Lego understood the warning but declined to provide a sample.
No breath alcohol concentration result appears in the complaint.
Two Criminal Charges Filed in Hubbard County
The first count alleges second-degree DWI test refusal, a gross misdemeanor.
It carries a stated maximum penalty of 364 days in jail, a $3,000 fine, or both.
Minnesota Statute 169A.25 treats certain breath-test refusals as second-degree DWI when an aggravating factor applies.
The complaint references a prior Cass County implied-consent incident posted June 25, 2026.
It does not describe that entry as a prior criminal conviction.
The second count alleges an open bottle violation, a misdemeanor.
The complaint lists a maximum penalty of 90 days in jail, a $1,000 fine, or both.
Minnesota’s open bottle law restricts possession of opened alcoholic beverages in certain parts of vehicles on public roads.
