MOORHEAD, Minn. (trfnews.i234.me) — A criminal case involving the death of a 9-year-old Moorhead boy is moving toward a possible plea hearing.

Victor Port, 64, of West Fargo, faces two misdemeanor charges following a deadly July 2025 crash.

The crash claimed the life of Adam Amin, who was riding his bicycle in a marked crosswalk.

Attorneys have now reported reaching an agreement that could resolve the case without a jury trial.

Attorneys Request Plea Hearing Instead of Trial

According to an October 26, 2026, letter filed in Clay County District Court, both sides have reached an agreement.

Port’s attorney, Luke Heck, asked the court to cancel the upcoming settlement conference and jury trial.

The attorney instead requested a plea hearing to address the proposed resolution.

The filing requested between 30 and 45 minutes for the hearing.

That time would allow Amin’s family to deliver a victim impact statement.

The attorney also asked that the family be allowed to participate remotely through Zoom.

The settlement conference was previously scheduled for October 29, with jury selection and trial proceedings planned for November 3.

The agreement’s specific terms have not been publicly detailed in the available report.

Deadly Crash Killed 9-Year-Old Boy

The charges stem from a July 31, 2025, crash in Moorhead.

Adam Amin was riding his bicycle through a marked crosswalk at 40th Avenue South and 14th Street South.

A City of Moorhead water truck, driven by Port, struck the child during a turn.

Amin died following the collision.

According to the criminal complaint, Port told investigators he stopped at the four-way intersection before making a left turn.

He reported hearing a loud sound near the truck’s front passenger-side tire.

Port told investigators he had not seen Amin before the collision.

The complaint states investigators found no evidence that Port was using his phone, distracted, or impaired.

Investigation Found Blind Spots and License Issues

The Minnesota State Patrol conducted a crash reconstruction following the collision.

Investigators found the truck stopped beyond the intersection’s white stop line.

Its front bumper may have extended into the crosswalk.

The investigation also identified blind spots near the truck’s front passenger side.

Those blind spots could prevent a driver from seeing a bicyclist within approximately six feet of the front bumper.

Authorities also discovered problems with Port’s commercial driver’s license.

His commercial license had been downgraded in 2024 because of an expired medical certification.

Investigators determined Port was operating the city truck with a regular Class D North Dakota driver’s license.

Two Misdemeanor Charges Filed

Prosecutors filed two misdemeanor charges against Port in February 2026.

The first charge alleges failure to yield to a pedestrian in a crosswalk.

The second alleges operating a vehicle without the required driver’s license.

Each charge carries a maximum penalty of 90 days in jail and a $1,000 fine.

These are possible maximum penalties, not a sentence imposed in the case.

Family May Address Court at Plea Hearing

The proposed hearing would provide Amin’s family an opportunity to address the court.

A victim impact statement allows relatives to describe how a death has affected their lives.

The court has not confirmed a completed plea or sentence in the information available for this report.

Port remains presumed innocent unless he enters an accepted guilty plea or is convicted in court.
