Waylen Ediver Olson, 46, is charged with gross misdemeanor Domestic Assault – Subsequent Violation (609.2242.2). Olson, who was heavily intoxicated, recorded a blood alcohol concentration (BAC) of 0.384, nearly five times the legal limit for driving. He had to be treated at Lifecare Medical Center before being booked into jail.
Details of the Incident
The incident occurred around 1:05 a.m. on January 3, 2026, at a home on the 300 block of McKinley St SW in Warroad. The victim, Olson’s nephew, told officers that Olson entered his bedroom while unscrewing a bottle of vodka and spilled it on the floor. When the victim provided washcloths to help clean the mess, Olson allegedly lunged at him, shoved his shoulder, and struck him in the forehead with an open palm.
Inside the house, officers found Olson in the basement, displaying signs of severe intoxication. His speech was slurred, and he had difficulty balancing. A physical struggle was evident in the victim’s bedroom, with an overturned chair and a rug out of place. The victim reported fear for his safety, saying he had never seen Olson act so aggressively before.

Court Proceedings
Olson was transported to the hospital for medical clearance after his high BAC level was confirmed. Bail was set at $1,200 with conditions, including a Domestic No Contact Order (DANCO), no contact with the victim, and no alcohol or controlled substances use. An alternative bail option of $30,000 was also set. Olson has a prior conviction for misdemeanor domestic assault in November 2023.
This case was filed in court on January 5, 2026, with the offense taking place on January 3, 2026.
