Thief River Falls Woman Charged After 0.19 DWI Test

Thief River Falls (trfnews.i234.me) — A Red Lake Falls woman faces a DWI charge after a Sept. 1 traffic stop.

Breanna Marie Gustafson, 25, was charged with third-degree driving while impaired.

The charge involves an alleged alcohol concentration of 0.16 or higher.

Gustafson was arrested following the traffic stop.

Driver Reported Swerving on Highway 32

The Pennington County Sheriff’s Office received a report about a motorist on Highway 32.

An off-duty Thief River Falls police officer reported that the vehicle was allegedly driving erratically.

The officer described the vehicle as traveling “all over the road,” according to the complaint.

Authorities later stopped the vehicle after Gustafson turned onto First Street.

The Highway 32 and First Street intersection is located in Thief River Falls.

When questioned, Gustafson allegedly said she did not remember swerving.

She also allegedly denied that she had been driving on Highway 32.

Police Report Signs of Alcohol Use

According to the complaint, Gustafson had bloodshot and watery eyes.

She allegedly told authorities she had consumed about two shots earlier that afternoon.

Gustafson said the drinks were consumed between 1 p.m. and 2 p.m.

Authorities then conducted field sobriety tests.

The complaint states Gustafson failed those tests.

She also provided a preliminary breath sample.

That test produced a reported alcohol concentration of 0.17.

Later Breath Test Reported at 0.19

Gustafson was taken to the Law Enforcement Center after her arrest.

A later breath test produced a reported alcohol concentration of 0.19.

The complaint lists that result as part of the case against her.

Minnesota Statute 169A.26 covers third-degree driving while impaired.

Third-degree DWI is a gross misdemeanor under Minnesota law.

Minnesota Statute 169A.03 defines a 0.16 alcohol concentration as an aggravating factor.

Information about county law enforcement is available from the Pennington County Sheriff’s Office.

The charge is an allegation and does not establish guilt.

Gustafson is presumed innocent unless proven guilty in court.
