Thief River Falls: Newfolden Man Faces Meth, DWI

Pennington County (trfnews.i234.me) A Newfolden man is facing multiple criminal charges after a traffic stop in Thief River Falls. Police say they found suspected drugs and drug items during the stop and later at the jail.

James Robert Ness, 56, Newfolden, has been charged with felony fifth-degree controlled substance crime. He is also charged with a gross misdemeanor, fifth-degree controlled substance crime. He also faces a charge of introducing contraband into a correctional facility. A fourth charge alleges fourth-degree DWI involving a controlled substance.

The complaint was filed Dec. 24.

Traffic stop near Highway 32

According to the complaint, police stopped Ness on Dec. 12. The stop happened near Main Avenue and Highway 32.

The complaint says Ness showed signs of recent drug use. It also says he failed some field sobriety tests.

When asked, Ness allegedly said he last used meth a couple of days earlier.

Search and K9 alert

Before the arrest, an officer found a bag of suspected marijuana on Ness, the complaint says.

Police later used search warrants to obtain a urine sample. They also searched Ness’ vehicle, the complaint says.

K9 Banner helped search the vehicle, according to the complaint.

The complaint says the K9 did not alert on the vehicle exterior. It says the K9 alerted near the center console.

Police say they found pill containers in the center console and the driver’s door.

Near the console, police also found a red cup holding a bong and a glass pipe, the complaint says.

The complaint says the bong and pipe had presumptive positive test results for meth.

Pills and alleged contraband

The complaint says one container held a Vyvanse pill and another pill. Vyvanse is listed as a Schedule II drug.

Police say another container held more pills. The pills were not identified when the complaint was written.

The complaint says the pills had no visible markings.

Ness was wearing Carhartt overalls during booking, according to the complaint.

Inside a breast pocket, a corrections supervisor allegedly found a container. The complaint says it held two baggies of white powder.

The substance later had a presumptive positive test for meth, the complaint says.

The complaint lists the weight as 8.7 grams, including the baggies. It also says a glass pipe was found.

When asked about the container, Ness allegedly denied seeing it before.
