Native American Rights and Burning Plastics: A Fergus Falls Man’s Arrest

FERGUS FALLS, Minn. (trfnews.i234.me) – Allen Charles Sheppard, age 48, was arrested on November 4 after a fire call at his residence in Fergus Falls. He has been charged with multiple offenses including felony obstructing the legal process, fourth-degree assault, and criminal property damage.

According to court records, Sheppard became irate when law enforcement officers arrived at the scene regarding the possible burning of illegal materials. He claimed that he was one of the last remaining chiefs of a Native American tribe and that the officer was violating the “peace treaty.” However, it was observed that plastics were being burned in the fire.

Sheppard refused to extinguish the fire despite multiple requests from law enforcement officers. Eventually, he was told that he was under arrest for obstructing the legal process. He resisted arrest and had to be dragged to the squad car. During transport, Sheppard kicked and resisted repeatedly, stating that more spray would be needed to stop him.

Sheppard provided a preliminary breath test value of 0.228 blood alcohol content at the Otter Tail County Jail. Court records indicate that he caused an estimated $1,104 in damage to the squad car.

Following Sheppard’s arrest, one of the officers involved in the incident required treatment for injuries at Lake Region Healthcare. Sheppard first appeared in Otter Tail County District Court on November 6 and remains in custody at the Otter Tail County Detention Center.
