MOORHEAD (trfnews.i234.me) — A Fargo man faces six charges following a May 22 incident at a Moorhead bar.

Casey Joseph O’Toole, 42, is charged in Clay County District Court.

The case stems from events at the Hen House Bar and Restaurant. The court file number is 14-CR-26-1758.

Bar Dispute Leads to Police Call

Police were sent to the business around 10:39 p.m. after a reported disturbance involving a firearm.

Witnesses said two men argued and moved close to each other. A manager told both men to stop.

The complaint alleges O’Toole threatened to get a gun. It also says he appeared intoxicated when he arrived.

The manager tried to collect O’Toole’s $27.20 tab. The manager also offered to arrange an Uber ride.

O’Toole allegedly left without paying and drove away. Police were told he used a white Ford F-350 pickup.

Arrest and Vehicle Search

An officer later found the pickup running in the parking lot. O’Toole was near the driver’s side.

The complaint says he stumbled, had slurred speech, and smelled strongly of alcohol.

It also says O’Toole struggled to follow instructions.

A witness reported seeing O’Toole urinate in the parking lot. Police then arrested him on suspicion of impaired driving.

At the Clay County Jail, O’Toole requested legal advice. He contacted an attorney before the testing process continued.

Authorities say O’Toole did not complete the requested breath test. The complaint lists refusal as a gross misdemeanor.

Police searched the pickup before it was towed. They reported finding a loaded Taurus 9mm handgun and additional ammunition.

Six Charges Filed

O’Toole faces two gross misdemeanor charges and four misdemeanor charges.

The counts include carrying a pistol without a permit and carrying a pistol while under alcohol’s influence.

He also faces impaired driving and breath-test refusal charges.

The remaining charges allege indecent exposure and theft of services. The alleged unpaid bill totaled $27.20.

The complaint lists maximum penalties of 364 days and $3,000 for each gross misdemeanor.

Each misdemeanor carries a listed maximum of 90 days and a $1,000 fine.
