Clay County, Minnesota (trfnews.i234.me) – A Moorhead man is facing two gross misdemeanor DWI charges following a July 2 traffic stop in the early morning hours.

According to a criminal complaint filed in Clay County District Court, Tyler John Bormann, 39, was pulled over by a Moorhead police officer around 12:02 a.m. after displaying signs of impairment. The officer noted bloodshot, watery eyes and a strong odor of alcohol.

Bormann allegedly admitted to drinking a beer and a mixed drink at Mick’s Office, a local bar. After showing signs of impairment during field sobriety tests, Bormann provided a preliminary breath test (PBT) sample of .098. He was arrested and taken to the Clay County Jail, where he later consented to a breath test that recorded his BAC at .10 at 12:50 a.m.

The complaint notes one aggravating factor due to a prior DUI conviction in Fargo Municipal Court in 2023 (Case No. FA-2023-CR-00058).

Bormann has been formally charged with:

  • Count I: 3rd Degree DWI – Operating Under the Influence of Alcohol

  • Count II: 3rd Degree DWI – Alcohol Concentration .08 or Greater Within 2 Hours

Each charge carries a maximum penalty of 364 days in jail and/or a $3,000 fine.
