Moorhead Man Charged After .19 DWI Test

MOORHEAD, Minn.(trfnews.i234.me) — A 19-year-old Moorhead man faces two gross misdemeanor DWI charges in Clay County.

Damian Casillas was charged in Minnesota’s Seventh Judicial District Court. The case was filed under court number 14-CR-26-2044.

The charges are allegations contained in a criminal complaint. They have not been proven in court.

Traffic Stop Leads to Arrest

The complaint alleges Casillas drove while impaired shortly after midnight on June 13, 2026.

A traffic stop occurred around 12:30 a.m. in Moorhead.

According to the complaint, Casillas admitted to drinking vodka found inside the vehicle.

The filing alleges he had slurred speech and smelled of alcohol.

The complaint also states Casillas did not pass field sobriety tests.

A preliminary breath test allegedly showed an alcohol concentration of .215.

Breath Test Allegedly Measured .19

Casillas was arrested and taken to the Clay County Jail.

The complaint says he received Minnesota’s breath test advisory.

Court records state Casillas agreed to a DataMaster breath test.

That test allegedly measured his alcohol concentration at .19.

The test reportedly occurred within two hours of Casillas driving.

The second charge uses Minnesota’s .08 DWI threshold.

Two Gross Misdemeanor Charges Filed

Prosecutors charged Casillas under Minnesota Statute 169A.20.

One count alleges driving while under the influence of alcohol.

The second count alleges an alcohol concentration of .08 or higher.

Prosecutors also alleged one aggravating factor in the case.

Third-degree DWI is a gross misdemeanor under Minnesota Statute 169A.26.

Each charge carries a maximum possible sentence of 364 days in jail.

Each count also carries a possible fine of up to $3,000.

Those penalties are maximums and are not a sentence.

The complaint includes an order of detention.
