McIntosh Man Charged with Felony Criminal Vehicular Homicide in Pennington County

📍 Pennington County, MN – A McIntosh man is facing multiple felony charges after allegedly driving under the influence, failing to stop at a stop sign, and causing a deadly crash in May 2024 that killed one woman and injured two others.


Crash Details

🗓 Date: May 3, 2024
Time: 9:22 p.m.
📍 Location: Intersection of 310th Avenue Northeast and Center Street, south of Goodridge, MN

🚗 Justin David Shultz, 39, of McIntosh, MN, was driving a 2005 Buick LeSabre southbound on 310th Avenue.

🚐 Mary Jean May, 49, of Red Lake, was driving a 2007 Chrysler Town & Country eastbound when Shultz allegedly failed to stop at a stop sign and struck the driver’s side of her vehicle.

🚨 The impact caused the van to overturn and land in a ditch, upside down, in standing water.


Victims & Injuries

🕊️ Mary Jean May was pronounced dead at the scene due to blunt force trauma to the head and neck.

🚑 Passengers in May’s vehicle suffered serious injuries:
🔹 Kimberly Ann Barrett, 44 – Multiple fractures, abrasions, and was hospitalized twice
🔹 Kiesha Barrett – Severe brain injuries, spinal fractures, and pulmonary contusions


Shultz’s Alleged Impairment & Arrest

👮 Police found Shultz confused and unable to sit up on his own.
👃 Officers smelled alcohol on him.
🍺 He initially denied drinking but later admitted to consuming alcohol.
🩸 A blood test revealed a Blood Alcohol Content (BAC) of 0.146, nearly twice the legal limit.

📵 Investigators also found that Shultz was using his phone “at or leading up to the time of the crash” without hands-free mode.

🔹 Felony Criminal Vehicular Operation – Great Bodily Harm
🔹 Misdemeanor Fourth-Degree DWI – 0.08 or More
🔹 Misdemeanor Failure to Stop at a Stop Sign
🔹 Petty Misdemeanor Expired Registration

🚔 Shultz has been summoned to appear in court on March 10.
