MAHNOMEN, MN (trfnews.i234.me) – Thomas Steven Libby, 62, of Mahnomen, has been sentenced to 48 months in prison after a Becker County jury found him guilty of felony DWI test refusal—his second felony-level offense.
The incident unfolded on February 10, 2024, around 12:57 a.m., when a White Earth officer spotted Libby’s vehicle in a ditch along County Highway 34. Inside were two men and an open alcohol container with blue liquid. Libby admitted to “drinking a few,” showed signs of intoxication, and refused field sobriety tests, stating, “No, I’ve been drinking.”
After being arrested and taken to jail, Libby was read the Minnesota breath test advisory, but twice refused to provide a sample. He declined legal counsel.
Libby had a prior felony DWI conviction from Clay County in 2004. On May 5, Judge Gretchen Thilmony sentenced him to St. Cloud prison, granting credit for 76 days served. His conditional release term is five years, and he was fined $50.
