Mahnomen Man Charged After 0.16 DWI Test
Mahnomen (trfnews.i234.me) — A Mahnomen man faces three charges after an early morning traffic stop on June 1.
Devin Rain Anderson, 25, is charged in Mahnomen County District Court. The charges include third-degree driving while impaired.
He also faces fourth-degree DWI and driving after revocation charges.
The third-degree DWI count is a gross misdemeanor. It carries a maximum penalty of 364 days in jail.
The charge also carries a possible fine of up to $3,000.
The remaining charges are misdemeanors. Each carries up to 90 days in jail and a $1,000 fine.
Jeep Stopped After Reported Erratic Driving
A court complaint says a deputy saw a dark Jeep miss a stop sign. The incident happened around 12:02 a.m.
The Jeep was near West Madison Avenue and First Street Northwest in Mahnomen.
The complaint says the vehicle then accelerated and entered the wrong traffic lane. It continued east on McKinley Avenue.
The deputy stopped the Jeep on Casino Road.
Anderson was identified as the driver, according to the complaint. Dispatch records showed his driving privileges were revoked.
The complaint says Anderson appeared slow and sluggish. It also describes watery eyes and slurred speech.

Complaint Describes Sobriety Tests
Anderson initially stayed inside the vehicle, the complaint says. He later stepped outside after several commands.
The deputy reported smelling alcohol on Anderson’s breath. Anderson denied drinking and blamed the smell on hand sanitizer.
Several field sobriety tests were then conducted.
The complaint says Anderson showed signs of impairment during an eye movement test.
It also says he missed heel-to-toe steps during a walking test. He stepped off the line and turned incorrectly.
During another test, Anderson used his arms for balance. He also placed his raised foot on the ground.
Breath Test Reported at 0.16
Anderson was arrested and taken to the Mahnomen County Sheriff’s Office.
He received Minnesota’s implied consent advisory and spoke with an attorney.
He then agreed to provide breath samples, according to the complaint.
A DataMaster test reported an alcohol concentration of 0.16. That level is twice Minnesota’s standard 0.08 driving limit.

The allegations have not been proven in court. Anderson is presumed innocent unless found guilty.
