GRAND FORKS, ND (trfnews.i234.me)—A Fort Totten man, Collin Wade Posey, was sentenced on Tuesday, Jan. 21, to serve seven years in prison for charges stemming from a standoff with law enforcement in Grand Forks. Posey, 32, pleaded guilty to Class B felony criminal mischief causing over $10,000 in damages and Class C felony preventing arrest. A third charge, Class C felony burglary, was dismissed at sentencing.

On July 22, an FBI agent requested assistance from Grand Forks law enforcement to apprehend Posey, who was a fugitive. Posey entered an apartment building through an open window when approached by the agent. Law enforcement contained the area and attempted for hours to get Posey to surrender using diversionary devices, chemical munitions, and less-lethal impact munitions. Posey did not comply.

After approximately seven hours, law enforcement entered the residence and found Posey hiding behind a couch. He was taken into custody without further incident. The apartment renter stated that Posey was unknown to her and not permitted to enter. She reported $100 in damages to her property, while the building owner later estimated damages exceeding $17,000.

Posey received a 10-year sentence with the North Dakota Department of Corrections and Rehabilitation, serving seven years in prison followed by three years of supervised probation. Violating probation conditions could result in serving the remainder of the sentence. He was ordered to pay $17,975.70 in restitution. The sentence will run concurrently with his other Grand Forks County cases, including charges of attempting to escape custody and failure to appear.

Posey also faces charges in a federal drug distribution case, and any federal sentence will be served consecutively to his current term.
