Cass County Man Charged After DWI Test Refusal
Cass County (trfnews.i234.me) — A Cass County man is facing a gross misdemeanor DWI charge after authorities say he refused a breath test following a vehicle incident in June.
Vehicle Found Stuck in the Yard
According to a criminal complaint filed in Cass County District Court, Mitchell Maurice McMahon, 40, of Adel, Iowa, was charged with refusing a chemical test in a DWI investigation.
The charge stems from an incident reported on June 19, 2026, in Cass County, Minnesota.
Court documents state that authorities responded to a report of a vehicle that had driven into a resident’s yard and become stuck.
The homeowner told investigators a male driver had crossed the yard before getting the vehicle stuck.
The homeowner said the situation appeared unusual.
The driver was the only person inside the vehicle, according to the complaint.
Driver Accused Of Showing Signs Of Impairment
Authorities said the driver appeared confused and had slow speech when questioned.
A nearby person directed officials to a cabin where the driver was staying.
According to court records, McMahon later came to the door.
The complaint states McMahon stumbled while walking and had bloodshot, watery eyes.
Officials also reported smelling a strong odor of alcohol on his breath.
McMahon allegedly told authorities he had been driving the vehicle.
He also reportedly said the vehicle keys were still inside the vehicle.
The complaint states he did not explain how the vehicle became stuck.

Breath Test Allegedly Refused
According to the complaint, McMahon refused field sobriety testing.
Officials also said he refused a preliminary breath test.
McMahon was later taken to the Cass County Law Enforcement Center in Walker.
He was given a breath test advisory, according to court records.
The complaint states that McMahon requested to contact an attorney.
After making phone calls, officials asked if he would complete a breath test.
Authorities said McMahon refused the chemical test.

McMahon is charged with Traffic DWI — refusing to submit to a chemical test.
The charge is listed as a gross misdemeanor under Minnesota law.
The offense carries a possible maximum penalty of 364 days in jail and a $3,000 fine.
Court records show McMahon does not appear to have an impaired driving incident within the past 10 years.
A prior Iowa OWI record from 2016 appears just outside that 10-year period, according to the complaint.
All charges are allegations, and McMahon is presumed innocent unless proven guilty in court.
