FARGO (trfnews.i234.me) — A Cass County jury has awarded $250,000 to a woman who was sexually assaulted as a minor during a house party in Fargo in 2019. Brian and Jennifer Berg, owners of the home where the assault occurred, were found 40% liable by the jury.

According to court documents, minors at the party brought alcohol into the Bergs’ home, leading to the assault on the victim by other minors present. The lawsuit accused the Bergs of failing to prevent minors from consuming alcohol and enforcing a curfew.

Interestingly, the jury also found a minor allegedly responsible for the assault to be 58% liable, although he was not a defendant in the case.

The victim’s attorney, Lindsay Wilz, expressed gratitude for the jury’s decision, emphasizing the importance of holding property owners accountable for ensuring the safety of minors at their premises.

Despite attempts, the Bergs’ attorney could not be reached for comment on the verdict.
