Bemidji Man Faces Burglary, Indecent Exposure Charges
Bemidji, Minnesota (trfnews.i234.me) — Darryl Isaac Malone faces two charges in Beltrami County District Court.
Prosecutors allege Malone returned to an apartment building two days after receiving a trespass notice.
The complaint says the notice barred him from 616 America Avenue NW until October 15, 2026.
The case was filed in Minnesota’s 9th Judicial District under court file 04-CR-26-925.
What Prosecutors Allege
According to the complaint, Malone was served the trespass notice on April 15, 2026.
The notice followed reports of sexual behavior in a common area of the building.
It barred Malone from returning to the property for six months.
Two days later, a witness reported seeing Malone inside the same building.
The witness said Malone was masturbating while viewing pornography on his phone, according to the complaint.
Investigators also obtained surveillance video showing Malone inside the building.
The complaint says the video was consistent with the witness’s statement.
Prosecutors say that report and video led to the current charges.
Burglary Charge Filed
Count One alleges fourth-degree burglary under Minnesota Statute 609.582, subdivision 4(a).
The charge applies to entering without consent to commit a misdemeanor other than theft.
It is a gross misdemeanor with a maximum penalty of 364 days in jail.
The maximum fine is $3,000, or both jail and a fine.
The burglary charge does not accuse Malone of theft.
Instead, prosecutors allege he entered without consent and committed another misdemeanor inside.
The indecent exposure count is the misdemeanor prosecutors link to that entry.
That connection forms the basis of the fourth-degree burglary allegation in the complaint.
Indecent Exposure Charge
Count Two alleges misdemeanor indecent exposure under Minnesota Statute 617.23, subdivision 1(3).
The statute covers open or gross lewdness or public indecency where others are present.
The maximum penalty is 90 days in jail, a $1,000 fine, or both.
Court Case Continues
The complaint lists April 17, 2026, as the alleged offense date.
The alleged conduct occurred in Bemidji, according to prosecutors.
Beltrami County prosecutors submitted the complaint in the 9th Judicial District.
The filing was issued as a summons.
