Ada, Minnesota (trfnews.i234.me) — A North Dakota man faces two first-degree driving while impaired charges in Norman County.

Adam John Kozojed, 44, of Davenport, North Dakota, is charged in Norman County District Court.

The charges stem from an incident on September 29, 2026.

Vehicle Found In Ditch

According to the criminal complaint, deputies were called to State Highway 32 near the Clay-Norman County line.

Authorities found Kozojed’s vehicle in a ditch on the Norman County side of the border.

Kozojed was reportedly the only person found in or near the vehicle.

The complaint alleges he appeared extremely intoxicated. Authorities said he had difficulty standing and needed help walking.

Investigators also reported seeing a beer can and a bottle of alcohol inside the vehicle.

Kozojed allegedly admitted that he had been drinking alcohol.

Field sobriety tests were not conducted because of his reported level of intoxication.

Complaint Alleges Breath Test Refusal

Kozojed was first taken to an emergency room in Ada for evaluation.

He was later taken to the Norman County Sheriff’s Office for breath testing.

According to the complaint, Kozojed received the breath test advisory and an opportunity to contact an attorney.

Authorities allege he then declined to provide a breath sample.

Count I charges Kozojed with first-degree DWI for refusing a chemical breath test.

The complaint lists the charge under Minnesota Statute 169A.20.

Three Prior Impaired Driving Incidents Alleged

Prosecutors allege Kozojed has three qualifying impaired driving incidents during the previous ten years.

They include a 2021 North Dakota DUI/APC conviction and a 2023 Minnesota DWI conviction.

The complaint also cites a 2019 implied-consent driver’s license loss in Idaho.

Count II charges Kozojed with first-degree DWI for allegedly operating or controlling a vehicle while under the influence of alcohol.

The complaint identifies Count II as a felony. It carries a maximum possible sentence of seven years in prison, a $14,000 fine, or both.

First-degree DWI provisions are detailed under Minnesota Statute 169A.24.

The charges are allegations. Kozojed is presumed innocent unless proven guilty in court.
