Clay County DWI Arrest Leads to Two Charges

Clay County (trfnews.i234.me) — A Fargo man is facing DWI charges after a July 2026 traffic stop in Clay County. Court documents say the stop led to allegations of impaired driving and refusal to complete a breath test.

Driver Accused of Impaired Driving

According to a criminal complaint filed in Clay County District Court, Tolulope Peter Ayanwale, 37, of Fargo, is charged with two DWI-related offenses.

The charges include operating a motor vehicle under the influence of alcohol and refusing a chemical breath test. The case was filed in Minnesota’s 7th Judicial District.

The complaint states the incident happened between July 4 and July 5, 2026. The charges stem from a traffic stop on Highway 10 in Clay County.

Traffic Stop on Highway 10

The complaint says a deputy observed a silver Toyota Camry traveling westbound on Highway 10 near 11:55 p.m.

The vehicle was reportedly traveling slower than normal traffic while staying in the left lane. The complaint states the vehicle did not move over when emergency lights were activated.

Officials said the vehicle later moved to the side of the highway. A traffic stop was then conducted based on driving concerns.

The complaint identifies the driver as Ayanwale. It states officers observed signs that included bloodshot and watery eyes.

Alcohol Evidence Cited in Complaint

Court documents state that a black flask was visible inside the vehicle. The complaint says Ayanwale provided the flask when asked.

The document states the flask smelled like alcohol. Ayanwale reportedly said it contained Jack Daniel’s whiskey.

The complaint says Ayanwale admitted drinking one Heineken beer about an hour before the stop.

According to the complaint, Ayanwale agreed to perform field sobriety tests. Officials reported seeing multiple signs of impairment during the tests.

Breath Test Refusal Alleged

The complaint states that a preliminary breath test was given during the investigation. The test reportedly showed a blood alcohol concentration of 0.127.

Ayanwale was arrested and taken to the Clay County Jail. The complaint states he was advised about the Minnesota breath test procedure.

Officials said Ayanwale attempted the official breath test three times. The complaint alleges he did not provide an acceptable sample.

The filing states that officers considered the actions a refusal of the evidentiary breath test.

Court Case Information

Ayanwale faces a gross misdemeanor charge for allegedly refusing a chemical test. He also faces a misdemeanor DWI charge.

A conviction could result in penalties including fines and possible jail time. The charges remain allegations, and the defendant is presumed innocent unless proven guilty in court.
