Moorhead Man Faces Felonies After Alleged Assault

Moorhead (trfnews.i234.me) — A 39-year-old Moorhead man faces two felony charges following an alleged assault involving his mother.

Emmanuel Martinez is charged in Clay County District Court with threats of violence and felony domestic assault.

Each charge carries a maximum sentence of five years in prison. Each also carries a possible $10,000 fine.

The allegations were filed in Clay County court case 14-CR-26-2227. Charges are accusations, and Martinez remains presumed innocent unless proven guilty.

According to the complaint, the incident happened at Silver Linings Apartments in Moorhead.

The complaint lists June 25, 2026, as the offense date. However, its probable-cause section lists July 25, 2026.

That second date falls after the complaint information provided. The difference appears to be a court document error.

The woman called law enforcement and identified Martinez as her son. Dispatchers reportedly heard a door slam during the call.

They also heard someone yell, “Stop hitting me,” before the telephone line became quiet.

Woman Reports Threat and Assault

The woman said Martinez was not supposed to be inside her apartment. She allowed him to enter after he requested bathroom access.

She alleged that Martinez then became aggressive. The complaint says he grabbed her face and made a death threat.

Martinez allegedly threw the woman backward by her face. She fell and later said the threat frightened her.

The complaint alleges Martinez then punched her head about seven times.

Responding officers reported seeing blood on the woman’s hand. Blood was also reportedly found in several areas of the apartment.

Prior Cases Cited

Prosecutors cited earlier North Dakota cases when seeking the enhanced felony domestic assault charge.

The complaint lists a 2023 terrorizing conviction and a 2021 contact-order violation. It also mentions another 2021 terroristic conviction.
