Complaint Alleges High BAC
Court records say Saice showed signs of impairment. Those signs included poor balance, slurred speech, and bloodshot, watery eyes.
Saice allegedly told officers he had three drinks. He also said he had not consumed alcohol since the crash.
The complaint says Saice performed an eye-based field sobriety test. Officers noted six out of six possible signs of impairment.
Authorities said Saice was too intoxicated to complete other field sobriety tests. He also allegedly refused a preliminary breath test.
Saice was arrested and later agreed to a breath test. The complaint says the final test showed a blood alcohol concentration of .29.

The complaint lists aggravating factors. Those include two prior DWI cases, a BAC over twice the legal limit, and children under 16 in the vehicle.
Saice is charged in Becker County Court File No. 03-CR-26-1055. The charge carries a maximum penalty of 364 days in jail, a $3,000 fine, or both.
A criminal complaint is not a conviction. Saice is presumed innocent unless proven guilty in court.
