Cass County (trfnews.i234.me) The federal trial for a Bemidji woman accused of assaulting a flight attendant has been canceled. Court records show an agreement is being prepared to resolve the case outside of trial.
The trial for Jodi Lynn Sherry-Berg was scheduled to begin today in federal court in Fargo. Berg was charged after an incident on a Las Vegas to Grand Forks flight last January. Prosecutors say she groped a flight attendant during the flight.
According to a new order filed by Judge Peter Welte, the jury trial has been canceled. The order states that both sides intend to file a pre-trial diversion agreement. This type of agreement allows a defendant to accept certain conditions in exchange for the possibility of the case being dismissed.
At this time, no additional documents have been filed outlining the terms of the agreement. The case remains active on the federal docket, and more information is expected as filings continue.
Background on the Case
Berg was originally arrested in Grand Forks on a state charge of providing false information to law enforcement. That charge was later dismissed when the case was transferred to federal court. She is now charged with interference with flight crew members and attendants.
The federal criminal complaint states that Berg “did knowingly interfere” with the duties of a flight attendant by assaulting them. Court records say Berg grabbed the attendant’s genitals during the flight, which disrupted the crew’s ability to perform their duties.
