Fargo: Hatchet Attack Case Paused for Treatment

Fargo, Cass County (trfnews.i234.me)  A Fargo woman charged with attempted murder will undergo court-ordered mental health treatment.

Investigators say Lena Deoliveira struck her boyfriend with a hatchet while he slept.

Court Orders Treatment

Court documents say Deoliveira was found not fit to proceed after an exam on Jan. 14.

A report filed Jan. 21 said she is not competent right now.

The report said she may be restored within the time allowed under North Dakota law.

Judge Ryan Younggren ordered the case paused while treatment happens.

The judge also ordered Deoliveira sent to the North Dakota State Hospital for restoration care.

The commitment can last up to 180 days.

You can learn more about the hospital here: North Dakota State Hospital.

State law on “fitness to proceed” is posted here: North Dakota Century Code, Chapter 12.1-04.

The court said it is unlikely she can pay for treatment.

The judge approved public spending to cover the cost.

The hospital must file a restoration report within 45 days.

It must then file a report every 30 days after that.
