CROOKSTON, Minn.<\/strong> (trfnews.i234.me<\/a>) \u2013 A Fargo man faces two gross misdemeanor DWI charges after a Minnesota State Patrol trooper found him asleep inside a running vehicle south of Crookston.<\/p>\n

Andrew Allen Juaire, 39, of Fargo<\/strong>, is charged with two counts of second-degree driving while impaired.<\/p>\n

According to a criminal complaint filed in Polk County District Court, a preliminary breath test registered an alcohol reading of .269<\/strong>.<\/p>\n

Trooper Finds Driver Asleep in Running Vehicle<\/h2>\n

The incident occurred October 24, 2026, at approximately 9:48 p.m.<\/p>\n

A Minnesota State Patrol trooper was traveling southbound on U.S. Highway 75, south of Crookston.<\/p>\n

The trooper noticed a vehicle stopped on the roadway near the intersection of 310th Street SW and 300th Avenue SW.<\/p>\n

According to the complaint, the trooper approached and discovered a man sleeping in the driver’s seat.<\/p>\n

The driver’s seat was reclined, and the vehicle’s engine was running with the keys in the ignition.<\/p>\n

The trooper also reported detecting an odor of alcohol coming from the vehicle.<\/p>\n

Driver Claims He Drank After Parking<\/h2>\n

After eventually waking up, the driver was identified as Juaire.<\/p>\n

According to court documents, the trooper noticed that Juaire’s speech was slurred.<\/p>\n

Juaire told the trooper he had consumed alcohol inside the vehicle only after parking.<\/p>\n

The trooper conducted field sobriety testing, including a preliminary breath test.<\/p>\n

The preliminary test produced an alcohol reading of .269<\/strong>, according to the complaint.<\/p>\n

Juaire was subsequently placed under arrest on suspicion of impaired driving.<\/p>\n

Medical Evaluation Leads to Hospital Transport<\/h2>\n

Shortly after his arrest, Juaire told authorities he believed he was experiencing a panic attack.<\/p>\n

Medical personnel evaluated him, and he was transported to an emergency room in Crookston.<\/p>\n

Investigators obtained a search warrant authorizing the collection of a blood or urine sample.<\/p>\n

Juaire agreed to provide a blood sample.<\/p>\n

A medical technologist collected the sample at approximately 12:09 a.m. on October 25.<\/p>\n

The complaint does not provide the results of laboratory testing on that blood sample.<\/p>\n

Prior DWI Conviction Cited in Charges<\/h2>\n

Prosecutors allege that two aggravating factors support the second-degree DWI charges.<\/p>\n

The complaint identifies a previous impaired-driving conviction dated November 3, 2017.<\/p>\n

It also alleges an alcohol concentration of at least .16 within the legally relevant testing period.<\/p>\n

However, the .269 figure cited in the probable cause statement came from a preliminary breath test.<\/p>\n

The complaint does not establish a final laboratory-confirmed blood alcohol concentration.<\/p>\n

Two Gross Misdemeanor Charges Filed<\/h2>\n

Juaire faces two counts of second-degree driving while impaired under Minnesota Statute 169A.20<\/a>.<\/p>\n

One count alleges an alcohol concentration of .08 or greater. The other alleges driving or being in physical control while under alcohol’s influence.<\/p>\n

Both counts involve the same October 24 incident.<\/p>\n

Each gross misdemeanor charge carries a maximum possible penalty of 364 days in jail, a $3,000 fine, or both.<\/p>\n

The penalties and offense classification are outlined in Minnesota Statute 169A.25<\/a>.<\/p>\n

Polk County Court Case<\/h2>\n

The case is filed in Minnesota’s Ninth Judicial District under court file number 60-CR-26-1583<\/strong>.<\/p>\n

The criminal complaint lists an order of detention.<\/p>\n

The allegations have not been proven in court. Juaire is presumed innocent unless and until proven guilty.<\/p>\n
