Ada: ND Man Charged In First-Degree DWI Case<\/h2>\n

Ada, Minnesota (trfnews.i234.me<\/a>)<\/strong> \u2014 A North Dakota man faces two first-degree driving while impaired charges in Norman County.<\/p>\n

Adam John Kozojed, 44, of Davenport, North Dakota, is charged in Norman County District Court.<\/p>\n

The charges stem from an incident on September 29, 2026.<\/p>\n

Vehicle Found In Ditch<\/h2>\n

According to the criminal complaint, deputies were called to State Highway 32 near the Clay-Norman County line.<\/p>\n

Authorities found Kozojed’s vehicle in a ditch on the Norman County side of the border.<\/p>\n

Kozojed was reportedly the only person found in or near the vehicle.<\/p>\n

The complaint alleges he appeared extremely intoxicated. Authorities said he had difficulty standing and needed help walking.<\/p>\n

Investigators also reported seeing a beer can and a bottle of alcohol inside the vehicle.<\/p>\n

Kozojed allegedly admitted that he had been drinking alcohol.<\/p>\n

Field sobriety tests were not conducted because of his reported level of intoxication.<\/p>\n

Complaint Alleges Breath Test Refusal<\/h2>\n

Kozojed was first taken to an emergency room in Ada for evaluation.<\/p>\n

He was later taken to the Norman County Sheriff’s Office for breath testing.<\/p>\n

According to the complaint, Kozojed received the breath test advisory and an opportunity to contact an attorney.<\/p>\n

Authorities allege he then declined to provide a breath sample.<\/p>\n

Count I charges Kozojed with first-degree DWI for refusing a chemical breath test.<\/p>\n

The complaint lists the charge under Minnesota Statute 169A.20<\/a>.<\/p>\n

Three Prior Impaired Driving Incidents Alleged<\/h2>\n

Prosecutors allege Kozojed has three qualifying impaired driving incidents during the previous ten years.<\/p>\n

They include a 2021 North Dakota DUI\/APC conviction and a 2023 Minnesota DWI conviction.<\/p>\n

The complaint also cites a 2019 implied-consent driver’s license loss in Idaho.<\/p>\n

Count II charges Kozojed with first-degree DWI for allegedly operating or controlling a vehicle while under the influence of alcohol.<\/p>\n

The complaint identifies Count II as a felony. It carries a maximum possible sentence of seven years in prison, a $14,000 fine, or both.<\/p>\n

First-degree DWI provisions are detailed under Minnesota Statute 169A.24<\/a>.<\/p>\n

The charges are allegations. Kozojed is presumed innocent unless proven guilty in court.<\/p>\n
