Hospital Report Leads to Investigation<\/h2>\n
Police responded to a local hospital on January 29 after receiving a sexual assault report.<\/p>\n
The 17-year-old reported being assaulted by Lund and another person named in the complaint.<\/p>\n
That person was identified in court records as Kylie Connie-Jean Wise.<\/p>\n
The teenager underwent a sexual assault examination at the hospital.<\/p>\n
Investigators later conducted a more detailed investigation into the allegations.<\/p>\n
The complaint says the teenager had met Wise through Snapchat about one month earlier.<\/p>\n
Wise later introduced the teenager to Lund, according to court records.<\/p>\n
Prosecutors allege Wise and Lund picked up the teenager on January 28.<\/p>\n
They then traveled to a Moorhead residence, where alcohol was consumed.<\/p>\n
Teenager Alleged She Said No<\/h2>\n
The complaint alleges sexual activity later occurred inside the residence.<\/p>\n
The teenager told investigators she repeatedly indicated that she did not consent.<\/p>\n
Prosecutors allege Lund engaged in sexual contact despite those objections.<\/p>\n
The complaint also alleges Wise used force against the teenager during the incident.<\/p>\n
The teenager reportedly became upset and asked to return home.<\/p>\n
Wise and Lund then drove her home, according to court records.<\/p>\n
TRF News is withholding the teenager’s identity because she was a minor.<\/p>\n
Investigators Cite Messages and DNA Evidence<\/h2>\n
Investigators reviewed Snapchat messages between the teenager and Wise.<\/p>\n
The complaint says those messages supported parts of the teenager’s account.<\/p>\n
Police also obtained surveillance video from the teenager’s apartment building.<\/p>\n
Authorities later obtained search warrants for DNA samples from Wise and Lund.<\/p>\n
Evidence was submitted to the Minnesota Bureau of Criminal Apprehension for testing.<\/p>\n
The complaint says testing found a Y-chromosome profile matching Lund on collected evidence.<\/p>\n
Investigators also reported semen on the teenager’s underwear.<\/p>\n
DNA analysis supported including Lund as a contributor to that mixture, according to the complaint.<\/p>\n
Charges Carry Significant Prison Terms<\/h2>\n
The first-degree charge falls under Minnesota Statute 609.342<\/a>.<\/p>\n That count carries up to 30 years in prison and a $40,000 fine.<\/p>\n The other counts fall under Minnesota Statute 609.344<\/a>.<\/p>\n Each third-degree count carries up to 15 years in prison.<\/p>\n Each also carries a possible fine of up to $30,000.<\/p>\n Criminal charges are allegations.
