According to the complaint, police were called to a gas station around 9:12 p.m.<\/p>\n
A caller reported seeing a man who appeared heavily impaired inside the store.<\/p>\n
The caller said the man was stumbling and tried to buy lottery tickets.<\/p>\n
The man then returned to a vehicle that was still running, according to the complaint.<\/p>\n
Police arrived and found a vehicle matching the caller’s description.<\/p>\n
Investigators identified the man as Edward Lewis Barbee.<\/p>\n
The complaint says Barbee had poor balance, slurred speech, and bloodshot, watery eyes.<\/p>\n
Police also reported a strong smell of alcohol coming from him.<\/p>\n
Barbee allegedly fell at one point and needed help standing again.<\/p>\n
Preliminary Test Reported at .32<\/h2>\n
Police attempted to conduct field sobriety testing, according to prosecutors.<\/p>\n
The complaint says testing stopped because officers believed continuing would be unsafe.<\/p>\n
A preliminary breath test allegedly showed an alcohol concentration of .32.<\/p>\n
Barbee was then arrested and taken to the Clay County Jail.<\/p>\n
At the jail, police read Barbee the breath test advisory.<\/p>\n
Prosecutors allege Barbee refused to provide the requested chemical breath sample.<\/p>\n
The complaint says Barbee was later taken to detox because of his level of impairment.<\/p>\n
Two Felony Counts Filed<\/h2>\n
Count One charges Barbee with felony chemical test refusal.<\/p>\n
