Defense Challenges Search Warrant<\/h2>\n
Attorneys for the Hulsts have filed motions asking a Clay County judge to suppress evidence.<\/p>\n
They argue the home search violated protections under the Fourth Amendment.<\/p>\n
Martin Hulst’s attorney, Michael Minard, filed a brief supporting the motion.<\/p>\n
Minard argued investigators relied heavily on information from one student witness.<\/p>\n
He described that information as unverified, unreliable, and insufficiently supported.<\/p>\n
The search warrant application outlined information investigators presented before searching the family’s home.<\/p>\n
Earlier THC Allegations Cited<\/h2>\n
Court documents say one student had previously reported THC vape cartridge sales at the school.<\/p>\n
The student allegedly identified the Hulsts’ daughter as the person supplying those cartridges.<\/p>\n
School officials searched backpacks and lockers connected to the report.<\/p>\n
No THC products or other contraband were found during those searches, court records state.<\/p>\n
The student also claimed she received cartridges at the Hulst home on two occasions.<\/p>\n
She further described an alleged cash transaction involving cartridges inside the residence.<\/p>\n
Video Shows Candy Being Shared<\/h2>\n
School video from the day students became sick showed the Hulsts’ daughter handling a red item.<\/p>\n
According to the warrant application, she then handed pieces to several students.<\/p>\n
The girl reportedly told investigators she received the candy after getting off a school bus.<\/p>\n
The warrant application said school video did not show that reported transaction.<\/p>\n
Minard argued investigators failed to sufficiently confirm the student witness’s earlier claims.<\/p>\n
He also argued authorities did not establish a clear link between the candy and the Hulst residence.<\/p>\n
Prosecutors Cite Items Found in Home<\/h2>\n
Clay County prosecutors say investigators later searched the Hulsts’ home on 10\u00bd Street North.<\/p>\n
Court filings allege officers found suspected THC flower, cartridges, and wax inside the residence.<\/p>\n
Prosecutors also allege psychedelic mushrooms and a large amount of cash were recovered.<\/p>\n
Martin Hulst filed his suppression motion in late June.<\/p>\n
His supporting brief was filed near the end of August.<\/p>\n
Amanda Hulst filed a similar motion on September 16.<\/p>\n
Her filing also seeks dismissal of the charges against her.<\/p>\n
Both defendants face felony drug sale and possession charges.<\/p>\n
They also face misdemeanor child endangerment allegations.<\/p>\n
The charges remain allegations unless proven in court.<\/p>\n
