It also lists a $30,000 fine and a five-year mandatory minimum.<\/p>\n
Shots Reported Near Allens Bay<\/h2>\n
According to the complaint, officers were dispatched around 5:09 a.m. after a report of gunshots.<\/p>\n
A caller reported seeing three people walking toward a park while shots were being fired.<\/p>\n
Officers later found four people walking near Kappes Lane and Luomas Lane.<\/p>\n
They included Hart, Keirra White, Anjessa Clark, and Kyle Lovelace.<\/p>\n
Daniel Wind then came from a nearby wooded area, according to the complaint.<\/p>\n
Officers told the group they were investigating a reported disturbance.<\/p>\n
Hart and White said they were looking for transportation to the Mission area.<\/p>\n
The complaint says officers searched Hart for weapons.<\/p>\n
No weapon was found on him during that search.<\/p>\n
Loaded Handgun Found In Bag<\/h2>\n
Police then searched a small black bag carried by White, the complaint states.<\/p>\n
Officers reported feeling what appeared to be a handgun inside.<\/p>\n
The bag contained a Springfield Armory XD 9mm handgun, according to the complaint.<\/p>\n
Police reported finding a live round in the chamber.<\/p>\n
A .45-caliber round also was found inside the bag, the complaint states.<\/p>\n
White later gave a statement after receiving a Miranda warning.<\/p>\n
She allegedly told investigators that Hart gave her the firearm.<\/p>\n
White denied firing the gun, according to the complaint.<\/p>\n
She also said her fingerprints would be on the weapon.<\/p>\n
Hart also gave a Mirandized statement.<\/p>\n
The complaint says he denied possessing the firearm.<\/p>\n
Prior Conviction Cited In Charge<\/h2>\n
Prosecutors say Hart cannot legally possess firearms because of a prior crime-of-violence conviction.<\/p>\n
The complaint identifies a 2021 first-degree drug possession conviction as the disqualifying offense.<\/p>\n
The complaint also says Hart was subject to conditional release in other pending cases.<\/p>\n
His conditions included remaining law-abiding and not possessing firearms.<\/p>\n
Those pending cases are separate matters.<\/p>\n
Pending charges do not establish guilt.<\/p>\n
