Alvarado: Toscano Cardenas Faces Knife Assault<\/h2>\n

ALVARADO, Minn.<\/strong> (trfnews.i234.me<\/a>) \u2014 Daniel Ivan Toscano Cardenas faces a felony assault charge following an alleged knife incident.<\/p>\n

The case was filed in Marshall County District Court.<\/p>\n

Toscano Cardenas, 45, is charged in court file 45-CR-26-259.<\/p>\n

The alleged incident happened Aug. 23, 2026, at a residence in Alvarado.<\/p>\n

Knife Allegedly Displayed During Argument<\/h2>\n

The criminal complaint says law enforcement responded to a reported assault involving a knife.<\/p>\n

A woman at the residence told investigators Toscano Cardenas had been drinking and arguing with her.<\/p>\n

She alleged he picked up a knife during the disagreement.<\/p>\n

The complaint says Toscano Cardenas then began walking toward her while holding the knife.<\/p>\n

She reportedly became frightened and ran outside.<\/p>\n

According to prosecutors, Toscano Cardenas then dropped the knife.<\/p>\n

The woman told investigators she believed he might have used the knife against her.<\/p>\n

She also reported feeling afraid during earlier incidents at the residence.<\/p>\n

No police officer names are included in this report.<\/p>\n

Toscano Cardenas Denied Threatening Woman<\/h2>\n

Investigators later contacted Toscano Cardenas at another nearby residence.<\/p>\n

He was taken into custody without incident, according to the complaint.<\/p>\n

The complaint says a preliminary breath test later produced a reading of 0.265.<\/p>\n

He was taken for medical clearance before returning to the Marshall County Jail.<\/p>\n

During an interview, Toscano Cardenas denied holding a knife.<\/p>\n

He also denied trying to threaten or frighten the woman.<\/p>\n

Investigators later returned to the residence for additional information.<\/p>\n

The woman again alleged Toscano Cardenas walked toward her while waving the knife.<\/p>\n

Police seized a knife identified as the one allegedly involved.<\/p>\n

Felony Assault Charge Filed<\/h2>\n

Prosecutors charged Toscano Cardenas with second-degree assault involving a dangerous weapon.<\/p>\n

The charge cites Minnesota Statute 609.222<\/a>, subdivision 1.<\/p>\n

The offense is a felony under Minnesota law.<\/p>\n

A conviction can carry up to seven years in prison.<\/p>\n

A fine of up to $14,000 is also possible.<\/p>\n

Those are maximum penalties and do not represent a sentence.<\/p>\n

Charge Remains an Allegation<\/h2>\n

The criminal complaint contains allegations that have not been proven in court.<\/p>\n

Toscano Cardenas is presumed innocent unless proven guilty beyond a reasonable doubt.<\/p>\n
