Bagley Man Charged With DWI Test Refusal<\/h2>\n

Clearwater County<\/strong> (trfnews.i234.me<\/a>) \u2014 A Cass Lake man is facing a gross misdemeanor charge after authorities say he refused a breath test during a suspected impaired driving investigation in Clearwater County.<\/p>\n

Gerald John Wizner, 59, of Cass Lake, is charged with third-degree refusal to submit to a chemical test. The charge was filed in Clearwater County District Court.<\/p>\n

The complaint states the alleged offense happened on July 9, 2026. The charge carries a possible sentence of up to 364 days in jail, a $3,000 fine, or both.<\/p>\n

Traffic Stop Near Bagley<\/h2>\n

According to the criminal complaint, authorities received a report of a possibly impaired driver leaving Daroo\u2019s restaurant in Bagley.<\/p>\n

The vehicle was later located on 340th Avenue south of Bagley. Authorities say the vehicle crossed the fog line and center line several times.<\/p>\n

A traffic stop was conducted, and Wizner was identified as the driver.<\/p>\n

The complaint states authorities noticed signs that suggested possible alcohol impairment. Those signs included the odor of alcohol, bloodshot watery eyes, and an open can of Michelob Ultra inside the vehicle.<\/p>\n

Wizner was asked to leave the vehicle. The complaint states he appeared unsteady and was slow to follow instructions.<\/p>\n

Breath Test Refusal Alleged<\/h2>\n

The complaint states a field sobriety test was attempted but was stopped after Wizner did not follow instructions.<\/p>\n

Authorities also say Wizner declined to provide a preliminary breath sample during the roadside investigation.<\/p>\n

Wizner was arrested and taken to the Clearwater County Jail<\/a>.<\/p>\n

After being read Minnesota\u2019s implied consent advisory, Wizner requested to speak with an attorney.<\/p>\n

The complaint states he was provided access to a telephone and legal information. He reportedly left one message before declining additional attempts.<\/p>\n

Court Records State Refusal Continued<\/h2>\n

Authorities say Wizner was asked to take a breath test after speaking with an attorney.<\/p>\n

The complaint states he first said he would not take the test. It also states he questioned the testing equipment and calibration.<\/p>\n

Officials say Wizner continued discussing the machine instead of giving a clear answer.<\/p>\n

The complaint states he was advised that continued delay could be considered a refusal.<\/p>\n

Authorities then determined Wizner had refused the chemical test.<\/p>\n

All charges are allegations, and Wizner is presumed innocent unless proven guilty in court.<\/p>\n
