Driver Accused of Impaired Driving<\/h2>\n

According to a criminal complaint filed in Clay County District Court, Tolulope Peter Ayanwale, 37, of Fargo, is charged with two DWI-related offenses.<\/p>\n

The charges include operating a motor vehicle under the influence of alcohol and refusing a chemical breath test. The case was filed in Minnesota\u2019s 7th Judicial District.<\/p>\n

The complaint states the incident happened between July 4 and July 5, 2026. The charges stem from a traffic stop on Highway 10 in Clay County.<\/p>\n

The complaint says a deputy observed a silver Toyota Camry traveling westbound on Highway 10 near 11:55 p.m.<\/p>\n

The vehicle was reportedly traveling slower than normal traffic while staying in the left lane. The complaint states the vehicle did not move over when emergency lights were activated.<\/p>\n

Officials said the vehicle later moved to the side of the highway. A traffic stop was then conducted based on driving concerns.<\/p>\n

The complaint identifies the driver as Ayanwale. It states officers observed signs that included bloodshot and watery eyes.<\/p>\n

Alcohol Evidence Cited in Complaint<\/h2>\n

Court documents state that a black flask was visible inside the vehicle. The complaint says Ayanwale provided the flask when asked.<\/p>\n

The document states the flask smelled like alcohol. Ayanwale reportedly said it contained Jack Daniel\u2019s whiskey.<\/p>\n

The complaint says Ayanwale admitted drinking one Heineken beer about an hour before the stop.<\/p>\n

According to the complaint, Ayanwale agreed to perform field sobriety tests. Officials reported seeing multiple signs of impairment during the tests.<\/p>\n

Breath Test Refusal Alleged<\/h2>\n

The complaint states that a preliminary breath test was given during the investigation. The test reportedly showed a blood alcohol concentration of 0.127.<\/p>\n

Ayanwale was arrested and taken to the Clay County Jail. The complaint states he was advised about the Minnesota breath test procedure.<\/p>\n

Officials said Ayanwale attempted the official breath test three times. The complaint alleges he did not provide an acceptable sample.<\/p>\n
