Moorhead Man Faces Felonies After Alleged Assault<\/h2>\n

Moorhead (trfnews.i234.me<\/a>)<\/strong> \u2014 A 39-year-old Moorhead man faces two felony charges following an alleged assault involving his mother.<\/p>\n

Emmanuel Martinez is charged in Clay County District Court with threats of violence and felony domestic assault.<\/p>\n

Each charge carries a maximum sentence of five years in prison. Each also carries a possible $10,000 fine.<\/p>\n

The allegations were filed in Clay County court case 14-CR-26-2227. Charges are accusations, and Martinez remains presumed innocent unless proven guilty.<\/p>\n

According to the complaint, the incident happened at Silver Linings Apartments in Moorhead.<\/p>\n

The complaint lists June 25, 2026, as the offense date. However, its probable-cause section lists July 25, 2026.<\/p>\n

That second date falls after the complaint information provided. The difference appears to be a court document error.<\/p>\n

The woman called law enforcement and identified Martinez as her son. Dispatchers reportedly heard a door slam during the call.<\/p>\n

They also heard someone yell, \u201cStop hitting me,\u201d before the telephone line became quiet.<\/p>\n

Woman Reports Threat and Assault<\/h2>\n

The woman said Martinez was not supposed to be inside her apartment. She allowed him to enter after he requested bathroom access.<\/p>\n

She alleged that Martinez then became aggressive. The complaint says he grabbed her face and made a death threat.<\/p>\n

Martinez allegedly threw the woman backward by her face. She fell and later said the threat frightened her.<\/p>\n

The complaint alleges Martinez then punched her head about seven times.<\/p>\n

Responding officers reported seeing blood on the woman\u2019s hand. Blood was also reportedly found in several areas of the apartment.<\/p>\n

Prosecutors cited earlier North Dakota cases when seeking the enhanced felony domestic assault charge.<\/p>\n
