Mahnomen Man Charged After 0.16 DWI Test<\/h2>\n

Mahnomen<\/strong> (trfnews.i234.me<\/a>) \u2014 A Mahnomen man faces three charges after an early morning traffic stop on June 1.<\/p>\n

Devin Rain Anderson, 25, is charged in Mahnomen County District Court. The charges include third-degree driving while impaired.<\/p>\n

He also faces fourth-degree DWI and driving after revocation charges.<\/p>\n

The third-degree DWI count is a gross misdemeanor. It carries a maximum penalty of 364 days in jail.<\/p>\n

The charge also carries a possible fine of up to $3,000.<\/p>\n

The remaining charges are misdemeanors. Each carries up to 90 days in jail and a $1,000 fine.<\/p>\n

Jeep Stopped After Reported Erratic Driving<\/h2>\n

A court complaint says a deputy saw a dark Jeep miss a stop sign. The incident happened around 12:02 a.m.<\/p>\n

The Jeep was near West Madison Avenue and First Street Northwest in Mahnomen.<\/p>\n

The complaint says the vehicle then accelerated and entered the wrong traffic lane. It continued east on McKinley Avenue.<\/p>\n

The deputy stopped the Jeep on Casino Road.<\/p>\n

Anderson was identified as the driver, according to the complaint. Dispatch records showed his driving privileges were revoked.<\/p>\n

The complaint says Anderson appeared slow and sluggish. It also describes watery eyes and slurred speech.<\/p>\n

Complaint Describes Sobriety Tests<\/h2>\n

Anderson initially stayed inside the vehicle, the complaint says. He later stepped outside after several commands.<\/p>\n

The deputy reported smelling alcohol on Anderson\u2019s breath. Anderson denied drinking and blamed the smell on hand sanitizer.<\/p>\n

Several field sobriety tests were then conducted.<\/p>\n

The complaint says Anderson showed signs of impairment during an eye movement test.<\/p>\n

It also says he missed heel-to-toe steps during a walking test. He stepped off the line and turned incorrectly.<\/p>\n

During another test, Anderson used his arms for balance. He also placed his raised foot on the ground.<\/p>\n

Breath Test Reported at 0.16<\/h2>\n

Anderson was arrested and taken to the Mahnomen County Sheriff\u2019s Office.<\/p>\n

He received Minnesota\u2019s implied consent advisory and spoke with an attorney.<\/p>\n

He then agreed to provide breath samples, according to the complaint.<\/p>\n

A DataMaster test reported an alcohol concentration of 0.16. That level is twice Minnesota\u2019s standard 0.08 driving limit.<\/p>\n
