Moorhead Balcony Break-In: Fargo Man Charged<\/h2>\n

MOORHEAD, Minn.<\/strong> (trfnews.i234.me<\/a>) \u2014 A Fargo man faces felony charges after an alleged apartment break-in early Monday.<\/p>\n

Kevin Eugene Thomas, 29, was charged Tuesday in Clay County District Court<\/a>. Prosecutors charged him with first-degree burglary and felony stalking.<\/p>\n

Thomas also faces two gross misdemeanor harassment charges. He was booked into the Clay County Jail<\/a>.<\/p>\n

Caller Reports Balcony Entry<\/h2>\n

A criminal complaint says Moorhead police responded around 2 a.m. on July 13. The call involved a reported burglary in progress.<\/p>\n

A 911 caller said Thomas entered through a second-floor patio door. The caller said a woman was trapped inside her bathroom.<\/p>\n

The caller also reported Thomas had a gun and made a death threat. Those claims are allegations listed in the complaint.<\/p>\n

Officers forced entry into the locked apartment. They found the woman inside the bathroom.<\/p>\n

The woman said Thomas climbed onto the balcony. She then saw him outside her bedroom window.<\/p>\n

She locked herself in the bathroom after he entered. Thomas allegedly tried to speak with her through the door.<\/p>\n

Complaint Describes Earlier Contact<\/h2>\n

The woman texted her mother during the incident. Her mother then called 911.<\/p>\n

The complaint says the woman was shaking and crying when officers spoke with her.<\/p>\n

Investigators said Thomas had entered the apartment on an earlier day. The complaint says he again used the balcony.<\/p>\n

The woman had changed the locks before the reported entry. Thomas allegedly said he wanted to talk with her.<\/p>\n

The complaint also describes many text messages before the July 13 incident. Messages continued during two nights, according to prosecutors.<\/p>\n

The woman had recently requested police help while collecting property from Thomas\u2019s home. That visit happened on July 10.<\/p>\n

Suspect Arrested Near Complex<\/h2>\n

Police saw movement near the patio door after reaching the apartment. Officers then spotted Thomas running near the complex.<\/p>\n

The complaint says he did not stop when ordered. Officers later caught him and arrested him.<\/p>\n

Under Minnesota law<\/a>, first-degree burglary can bring up to 20 years in prison. It can also carry a $35,000 fine.<\/p>\n

The charges remain allegations. Thomas is presumed innocent unless proven guilty in court.<\/p>\n
