The charge is a gross misdemeanor.<\/p>\n<p>He also faces a misdemeanor charge for failing to provide proof of vehicle insurance.<\/p>\n<h2>Traffic Stop Began Over Taillights<\/h2>\n<p>A Leech Lake Tribal Police officer was patrolling Cass Lake around 3:23 a.m., according to the complaint.<\/p>\n<p>The officer saw a vehicle traveling south on 61st Avenue. The complaint says the vehicle had no working taillights.<\/p>\n<p>The officer activated emergency lights and attempted a traffic stop. The vehicle stopped briefly near John Moose Drive.<\/p>\n<p>It then turned north and continued toward Morningstar Lane. The vehicle later stopped near that intersection.<\/p>\n<h2>Driver Initially Declined To Identify Himself<\/h2>\n<p>The complaint says the officer approached the driver and requested identification and proof of insurance.<\/p>\n<p>The driver initially declined to answer questions. He also declined to provide a license or insurance information.<\/p>\n<p>The driver later identified himself as Jerod Wesley Howard, the complaint states.<\/p>\n<p>Dispatch reported that Howard\u2019s driving privileges were canceled as being inimical to public safety.<\/p>\n<p>Dispatch also reported an active Hubbard County warrant, according to the filed complaint.<\/p>\n<p>The complaint notes a strong marijuana odor from the vehicle. No drug charge appears in this complaint.<\/p>\n<h2>Charges Filed In Cass County<\/h2>\n<p>The driving charge falls under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/171.24\" target=\"_blank\" rel=\"noopener\">Minnesota Statute 171.24<\/a>.<\/p>\n<p>The complaint lists a maximum penalty of 364 days in jail, a $3,000 fine, or both.<\/p>\n<p>The insurance charge falls under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/169.791\" target=\"_blank\" rel=\"noopener\">Minnesota Statute 169.791<\/a>.<\/p>\n<p>That charge carries a listed maximum of 90 days, a $1,000 fine, or both.<\/p>\n<p>The new matter is filed under Cass County court file 11-CR-26-620.<\/p>\n<p>The complaint also cites another pending Cass County case involving alleged DWI test refusal.<\/p>\n<p>It says Howard was under release conditions in that matter.
