Moorhead Man Charged After Roseau County Stop<\/h2>\n

ROSEAU COUNTY<\/strong> (trfnews.i234.me<\/a>) \u2014 A Moorhead man faces three charges after a June 9 traffic stop.<\/p>\n

Jermane T. Johnson, 51, is charged with refusing a court-ordered chemical test.<\/p>\n

He also faces charges for giving a false name and driving under the influence of a controlled substance.<\/p>\n

The allegations appear in a complaint filed in Minnesota\u2019s Ninth Judicial District.<\/p>\n

Charges are accusations, and Johnson is presumed innocent unless proven guilty.<\/p>\n

Traffic Stop on Highway 11<\/h2>\n

According to the complaint, a deputy clocked a vehicle traveling 85 mph on Highway 11.<\/p>\n

The stop began near 340th Avenue at about 6:07 a.m.<\/p>\n

The vehicle continued for about two miles after emergency lights were activated.<\/p>\n

It then swerved onto the shoulder and nearly struck a mailbox, the complaint states.<\/p>\n

The driver said he was heading to Karlstad. However, authorities said he was traveling in the wrong direction.<\/p>\n

The driver first gave another name and birth date, according to the complaint.<\/p>\n

He also said he did not have his driver\u2019s license.<\/p>\n

Sobriety Tests and Arrest<\/h2>\n

The complaint says the driver showed rapid speech and dilated pupils.<\/p>\n

He declined walking tests because of his weight.<\/p>\n

Authorities then used two other field sobriety tests.<\/p>\n

The complaint says Johnson showed signs that raised concerns about possible drug use.<\/p>\n

Johnson reportedly admitted to using marijuana the previous night.<\/p>\n

He also reported having an Adderall prescription but denied taking it recently.<\/p>\n

Authorities arrested Johnson on suspicion of drug-impaired driving and providing a false name.<\/p>\n

Identity Confirmed at Jail<\/h2>\n

Johnson later gave his real name during a phone call concerning his dog.<\/p>\n

Authorities then took him to the Roseau County Jail.<\/p>\n

During a jail search, authorities found Johnson\u2019s driver\u2019s license hidden inside his sock.<\/p>\n

They also reported finding a cannabis package in the same sock.<\/p>\n

A judge approved a search warrant for a blood or urine sample.<\/p>\n

The complaint says Johnson received a copy of that warrant.<\/p>\n

Authorities told Johnson that refusing the test could result in another criminal charge.<\/p>\n

Johnson refused hospital transport and declined to provide a urine sample, according to the complaint.<\/p>\n

He was booked on suspicion of third-degree DWI test refusal and providing a false name.<\/p>\n

Charges and Possible Penalties<\/h2>\n

The two gross misdemeanor counts each carry a maximum sentence of 364 days.<\/p>\n

Each count also carries a possible fine of up to $3,000.<\/p>\n

The controlled-substance DWI count is a misdemeanor.<\/p>\n

That charge carries up to 90 days in jail and a possible $1,000 fine.<\/p>\n
