Moorhead Man Charged After .19 DWI Test<\/h2>\n

MOORHEAD, Minn.<\/strong> \u2014 (trfnews.i234.me)<\/a> \u2014 A 19-year-old Moorhead man faces two gross misdemeanor DWI charges in Clay County.<\/p>\n

Damian Casillas was charged in Minnesota\u2019s Seventh Judicial District Court. The case was filed under court number 14-CR-26-2044.<\/p>\n

The charges are allegations contained in a criminal complaint. They have not been proven in court.<\/p>\n

Traffic Stop Leads to Arrest<\/h2>\n

The complaint alleges Casillas drove while impaired shortly after midnight on June 13, 2026.<\/p>\n

A traffic stop occurred around 12:30 a.m. in Moorhead.<\/p>\n

According to the complaint, Casillas admitted to drinking vodka found inside the vehicle.<\/p>\n

The filing alleges he had slurred speech and smelled of alcohol.<\/p>\n

The complaint also states Casillas did not pass field sobriety tests.<\/p>\n

A preliminary breath test allegedly showed an alcohol concentration of .215.<\/p>\n

Casillas was arrested and taken to the Clay County Jail.<\/p>\n

The complaint says he received Minnesota\u2019s breath test advisory.<\/p>\n

Court records state Casillas agreed to a DataMaster breath test.<\/p>\n

That test allegedly measured his alcohol concentration at .19.<\/p>\n

The test reportedly occurred within two hours of Casillas driving.<\/p>\n

The second charge uses Minnesota\u2019s .08 DWI threshold.<\/p>\n

Two Gross Misdemeanor Charges Filed<\/h2>\n

Prosecutors charged Casillas under Minnesota Statute 169A.20<\/a>.<\/p>\n

One count alleges driving while under the influence of alcohol.<\/p>\n

The second count alleges an alcohol concentration of .08 or higher.<\/p>\n

Prosecutors also alleged one aggravating factor in the case.<\/p>\n

Third-degree DWI is a gross misdemeanor under Minnesota Statute 169A.26<\/a>.<\/p>\n

Each charge carries a maximum possible sentence of 364 days in jail.<\/p>\n

Each count also carries a possible fine of up to $3,000.<\/p>\n
