Clay County DWI Stop Leads to Three Charges<\/h2>\n

CLAY COUNTY<\/strong> (trfnews.i234.me<\/a>) \u2014 A Fargo woman faces three charges after a June 7 traffic stop.<\/p>\n

Amber Rose Nicole Davidson, 23, is charged with third-degree DWI test refusal, fourth-degree DWI, and obstructing legal process.<\/p>\n

The most serious count is a gross misdemeanor. It carries up to 364 days in jail. A conviction could also bring a $3,000 fine.<\/p>\n

The two remaining counts are misdemeanors. Each carries up to 90 days in jail and a $1,000 fine.<\/p>\n

Traffic Stop Followed Driving Report<\/h2>\n

According to the complaint, dispatch received a report about two possibly intoxicated people in a dark Nissan SUV.<\/p>\n

A Clay County deputy later saw the vehicle traveling south on Highway 9. The complaint says the SUV moved sharply.<\/p>\n

The vehicle also crossed the fog line several times, according to the filing. It then turned onto 28th Avenue North.<\/p>\n

A deputy stopped the SUV after observing the reported driving. The vehicle stopped partly over the fog line.<\/p>\n

Driver Allegedly Refused Tests<\/h2>\n

Davidson was identified as the driver. A male passenger was also inside the vehicle.<\/p>\n

The complaint says Davidson admitted to drinking alcohol several hours earlier. She allegedly refused a preliminary breath test.<\/p>\n

She also refused field sobriety tests, according to the complaint. Deputies reported that her speech appeared slurred.<\/p>\n

Davidson reportedly said prescription medication affected her driving. The complaint says deputies then placed her under arrest.<\/p>\n

Complaint Describes Resistance<\/h2>\n

The filing alleges Davidson refused to leave the vehicle. Deputies removed her after she held the steering wheel.<\/p>\n

The complaint says she continued resisting outside the SUV. Deputies then placed her in handcuffs.<\/p>\n

Davidson was taken to the Clay County Jail. There, she received Minnesota\u2019s breath test advisory.<\/p>\n

The advisory explains that refusing a required breath test can be a crime. Davidson allegedly refused the test.<\/p>\n

Charges Remain Pending<\/h2>\n

The charges are allegations and have not been proven in court. Davidson is presumed innocent unless convicted.<\/p>\n
