Fosston Shooting Suspect Released as Probe Continues<\/h2>\n

FOSSTON<\/strong> (trfnews.i234.me<\/a>) \u2014 A Fosston man arrested after a fatal apartment shooting has been released from custody.<\/p>\n

Cory Burnette Jr., 22, was arrested Monday after TeeJay Alvarez, 31, was shot inside a Mark Avenue apartment.<\/p>\n

The shooting happened in the 300 block of Mark Avenue in Fosston.<\/p>\n

Alvarez was taken for medical care after the shooting. He died Tuesday morning at Essentia Health in Fargo<\/a>.<\/p>\n

Why Burnette Was Released<\/h2>\n

The Polk County Attorney\u2019s Office<\/a> announced Burnette\u2019s release on Wednesday.<\/p>\n

Prosecutors said they cannot decide on charges until the full investigation is complete. That review includes the final autopsy report.<\/p>\n

Burnette had been held at the Northwest Regional Correctional Center in Crookston.<\/p>\n

He was held on probable cause for second-degree assault and discharging a firearm.<\/p>\n

A probable-cause hold does not mean formal charges have been filed.<\/p>\n

The attorney\u2019s office said state law limits how long someone may be held without charges.<\/p>\n

Officials said Burnette was released because the investigation remains unfinished.<\/p>\n

The release does not end the investigation. Prosecutors may review the case after receiving all reports and evidence.<\/p>\n

Investigation Remains Active<\/h2>\n

The attorney\u2019s office said it will not provide more public comment for now.<\/p>\n

The office plans to speak again after the investigation ends and a charging decision is made.<\/p>\n

The Fosston Police Department is leading the investigation.<\/p>\n

Several agencies are assisting with the case.<\/p>\n

They include the Polk County Sheriff\u2019s Office<\/a> and the Minnesota Bureau of Criminal Apprehension<\/a>.<\/p>\n

The Minnesota Department of Natural Resources<\/a> is also assisting.<\/p>\n

The Minnesota State Patrol<\/a> is providing additional support.<\/p>\n

Authorities have not announced a final cause or manner of death.<\/p>\n

No criminal charge had been announced when officials released their statement on Wednesday.<\/p>\n

The case remains under review by investigators and prosecutors.<\/p>\n

An arrest is not a conviction. A person is presumed innocent unless proven guilty in court.<\/p>\n

Further updates are expected after the final autopsy and investigation are completed.<\/p>\n
