Tori Misty Myslajek has been charged in Beltrami County District Court. The charge alleges she operated a motor vehicle with an alcohol concentration of 0.08 or higher within two hours of driving.<\/p>\n

Traffic Stop On Paul Bunyan Drive<\/h2>\n
According to the criminal complaint, a Minnesota State Patrol trooper stopped a vehicle around 1:12 a.m. The stop happened near the 200 block of Paul Bunyan Drive South.<\/p>\n
The complaint says the vehicle had no front license plate. It also had dark window tint, according to court records. A suspended object was also seen hanging from the rear-view mirror.<\/p>\n
Myslajek was identified as the driver and sole occupant of the vehicle.<\/p>\n
Authorities said the trooper noticed a strong perfume-like smell during the stop. The complaint also says Myslajek had bloodshot, watery eyes and droopy eyelids.<\/p>\n
Breath Test Allegations<\/h2>\n
The complaint says Myslajek told authorities she worked at a local hospital. She said she finished her shift around midnight.<\/p>\n
She also said she left her hotel about ten minutes before the stop. She first denied drinking alcohol or taking medication before driving.<\/p>\n
Authorities asked Myslajek to perform field sobriety tests. The complaint says she did not perform the tests satisfactorily.<\/p>\n
After the tests, Myslajek allegedly said she had a glass of wine earlier that night. She again denied using medication.<\/p>\n
A preliminary breath test reportedly showed a result of 0.267. Myslajek was then arrested and taken to the Beltrami County Jail.<\/p>\n
Authorities later requested a breath sample after reading the breath test advisory. Court documents say Myslajek agreed to testing.<\/p>\n

The charge is listed as a gross misdemeanor under Minnesota Statute 169A.20<\/a>.<\/p>\n The maximum penalty is 364 days in jail and a $3,000 fine.
