The case is listed as Court File No. 39-CR-26-70.<\/p>\n<p>Nelson is charged with third-degree DWI, third-degree DWI with an alcohol level of .08 or more, and fourth-degree assault of a peace officer.<\/p>\n<h2>Noise Complaint Led To Contact<\/h2>\n<p>The complaint says deputies responded around 10:14 p.m. to Zippel Avenue in Williams. A caller reported a dark gray SUV playing loud music near a church.<\/p>\n<p>A deputy reported hearing the music from a squad car. The driver was later identified as Nelson.<\/p>\n<p>Authorities allege Nelson was uncooperative at first. The complaint says he eventually gave deputies his driver\u2019s license.<\/p>\n<p>Deputies reported smelling alcohol. Nelson allegedly said he had been smoking weed and drinking earlier.<\/p>\n<p>According to the complaint, deputies saw open Twisted Tea cans inside the vehicle. They also reported seeing a vape and more containers within reach.<\/p>\n<h2>Field Tests And Breath Result<\/h2>\n<p>Nelson allegedly agreed to field sobriety testing. Deputies reported several signs of impairment during the tests.<\/p>\n<p>The complaint says Nelson was then arrested for DWI. A search of the vehicle allegedly found a glass pipe, two lighters, and an empty jar.<\/p>\n<p>During transport, Nelson allegedly said he had \u201csix drinks.\u201d At the jail, deputies read him the breath test advisory.<\/p>\n<p>The complaint says Nelson asked to speak with an attorney. He later decided not to speak with one.<\/p>\n<p>Authorities allege a DMT breath test showed a .09 result. Minnesota\u2019s DWI law can be reviewed through the <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/169a.20\" target=\"_blank\" rel=\"noopener\">Minnesota Revisor of Statutes<\/a>.<\/p>\n<h2>Jail Incident Alleged<\/h2>\n<p>The complaint says Nelson became upset during the jail booking process. Deputies alleged he refused to follow jail clothing and jewelry rules.<\/p>\n<p>Authorities allege Nelson resisted when deputies tried to remove a necklace and ring. The complaint says he later kicked a deputy while being moved to a cell.<\/p>\n<p>Deputies also alleged Nelson splashed water onto a deputy\u2019s legs. The water reportedly reached the hallway outside the cell.<\/p>\n<p>Third-degree DWI is covered under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/169a.26\" target=\"_blank\" rel=\"noopener\">Minnesota Statute 169A.26<\/a>. Fourth-degree assault provisions are listed under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/609.2231\" target=\"_blank\" rel=\"noopener\">Minnesota Statute 609.2231<\/a>.<\/p>\n<p>Court records can be searched through <a href=\"https:\/\/publicaccess.courts.state.mn.us\/CaseSearch\" target=\"_blank\" rel=\"noopener\">Minnesota Court Records Online<\/a>.<\/p>\n<p>A criminal complaint is not a conviction.
