Judge Allows Case To Continue<\/h2>\n
Judge Christa Daily ruled the case should move forward in Olmsted County Court<\/a>. The judge denied a defense motion that sought to dismiss the charges.<\/p>\n In her ruling, Daily said the complaint describes direct and highly inflammatory language. She said the alleged words were used face to face in a tense setting.<\/p>\n The judge also said the situation showed a possible risk of quick escalation. Because of that, she ruled dismissal was not proper at this stage.<\/p>\n Shiloh Hendrix<\/p>\n<\/div>\n Hendrix was identified in a video first posted on TikTok<\/a> during the week of April 28, 2025. The video showed a man confronting Hendrix after the alleged incident.<\/p>\n The confrontation happened at Roy Sutherland Playground, located at Soldiers Field Park in Rochester.<\/p>\n Daily also ruled that the words Hendrix was recorded using may fall under \u201cfighting words.\u201d That term refers to speech that may not receive First Amendment protection.<\/p>\n The fighting words doctrine<\/a> is a narrow legal rule. It can apply when words are likely to cause an immediate breach of peace.<\/p>\n Hendrix is scheduled to appear for a pretrial hearing on July 14. Her trial is set to begin July 20.<\/p>\n A jury will decide whether Hendrix\u2019s alleged actions meet the legal standard for disorderly conduct.
