{"id":27660,"date":"2026-05-01T07:30:35","date_gmt":"2026-05-01T12:30:35","guid":{"rendered":"https:\/\/trfnews.i234.me\/wordpress\/?p=27660"},"modified":"2026-05-01T06:20:30","modified_gmt":"2026-05-01T11:20:30","slug":"red-lake-man-faces-felony-dwi-refusal-charge","status":"publish","type":"post","link":"https:\/\/trfnews.i234.me\/wordpress\/red-lake-man-faces-felony-dwi-refusal-charge\/","title":{"rendered":"Red Lake Man Faces Felony DWI Refusal Charge"},"content":{"rendered":"<p><strong>Beltrami County<\/strong> (<a href=\"https:\/\/trfnews.i234.me\" target=\"_blank\" rel=\"noopener\">trfnews.i234.me<\/a>) \u2014 A Red Lake man is facing a felony DWI refusal charge in Beltrami County District Court.<\/p>\n<p>Donovan Marshall May, 50, of Red Lake, is charged with first-degree DWI refusal to submit to a breath test.<\/p>\n<p>May is also charged with driving without a required ignition interlock device.<\/p>\n<p>The second charge is listed as a gross misdemeanor.<\/p>\n<p>The court file number is 04-CR-26-880.<\/p>\n<p>The charges stem from an April 19, 2026, traffic stop in Beltrami County.<\/p>\n<h2>Traffic Stop Leads To Arrest<\/h2>\n<p>According to the complaint, a Beltrami County deputy was on patrol around 9 p.m.<\/p>\n<p>The deputy was traveling on Pleasant Valley Road NW.<\/p>\n<p>The complaint says a vehicle had a non-working license plate light.<\/p>\n<p>The issue made the rear plate hard to see, according to court records.<\/p>\n<p>The vehicle was stopped, and May was identified as the driver.<\/p>\n<p>According to the complaint, May showed signs of alcohol impairment.<\/p>\n<p>Those signs included red, watery eyes and an odor of alcohol.<\/p>\n<p>Investigators also found that May was required to use an ignition interlock device.<\/p>\n<p>No ignition interlock device was found in the vehicle, according to the complaint.<\/p>\n<div style=\"text-align: center; margin: 25px 0;\"><img decoding=\"async\" style=\"max-width: 100%; height: auto; border-radius: 6px;\" src=\"https:\/\/trfnews.i234.me\/wordpress\/wp-content\/uploads\/2026\/04\/MayDonovan.png\" alt=\"Donovan Marshall May mugshot\" \/><em>Donovan Marshall May<\/em><\/p>\n<\/div>\n<h2>Breath Test Refusal Alleged<\/h2>\n<p>The complaint says May refused a preliminary breath test.<\/p>\n<p>He allegedly said he would fail if he gave a breath sample.<\/p>\n<p>May was then taken to the Beltrami County Jail.<\/p>\n<p>At the jail, he was read Minnesota\u2019s implied consent advisory.<\/p>\n<p>That advisory explains that refusing a breath test can be a crime.<\/p>\n<p>According to the complaint, May again refused to provide a breath test.<\/p>\n<p>The felony count was filed under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/169A.20\" target=\"_blank\" rel=\"noopener\">Minnesota Statute 169A.20<\/a>.<\/p>\n<p>The first-degree DWI reference appears under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/169A.24\" target=\"_blank\" rel=\"noopener\">Minnesota Statute 169A.24<\/a>.<\/p>\n<p>The ignition interlock count was filed under <a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/171.09\" target=\"_blank\" rel=\"noopener\">Minnesota Statute 171.09<\/a>.<\/p>\n<h2>Prior DWI Convictions Listed<\/h2>\n<p>Court records list three prior non-felony DWI convictions for May.<\/p>\n<p>Those convictions were entered in 2022 and 2025.<\/p>\n<p>The felony DWI refusal charge carries a maximum sentence of seven years.<\/p>\n<p>It may also carry a $14,000 fine, or both.<\/p>\n<p>The ignition interlock charge carries up to 364 days in jail.<\/p>\n<p>It may also carry a $3,000 fine, or both.<\/p>\n<p>Public court records can be searched through <a href=\"https:\/\/publicaccess.courts.state.mn.us\/CaseSearch\" target=\"_blank\" rel=\"noopener\">Minnesota Court Records Online<\/a>.<\/p>\n<p>A criminal complaint is not a conviction.<\/p>\n<p>May is presumed innocent unless proven guilty in court.<\/p>\n<p>I\u2019m Chris Harper reporting for <a href=\"https:\/\/trfnews.i234.me\" target=\"_blank\" rel=\"noopener\">TRF News<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Beltrami County (trfnews.i234.me) \u2014 A Red Lake man is facing a felony DWI refusal charge in Beltrami County District Court.
